Case “Subventions”

At Wednesday's session at the Foundation Court in Pristina, in the “case Subventions”, defender of accused Luan Statovci, lawyer Naim Rudari, called for the exemption of court chairman, Judge Medee Bytyqi.
The procedure in this case had joined for 28 indictees, but for two procedures has been set aside, while six have reached agreement for guilty admission. Now they're being accused: Hasan Maharaj, Luan Statovci, Salih Statovci, Kumrije Maharaj, Mejm Zaraj, Sadat Shkodra, Aferdita Gjokaj, Bejtullah Piri, Feriz Jonuzi, Alban Novosella, Berat Nika, Lulzim Hajdaraj, Bajram Gashi, Artan Elezi, Union Mani, Halil Krasniqi, Almir Abdurrahmani, Red, Freedom Fadhrim and Rasim Zeqaj, reports “ Periscope.
The request for the expulsion of Judge Bytyqi came after the lawyer Rudari claimed the decision to postpone the hearing, the court had taken it before the start of the session, adding that such a decision was read by Judge Bytyqi and did not be filed in the process.
“... the jury panel consulted itself, but the head of the court read the verdict and assessment of medical documentation, which was actually read by the head of the court, was not written in real time, but it is now believed that if it was written in the chip, it was written in office”, the lawyer Rudari stated.
The lawyer added that the “that happened in the trial results in that the court's decision is following the admission of our positions regarding the postponement of the hearing, but it is in fact emerging that our positions are only on the face of the page because the decision was made in the” office.
So, based on these, lawyer Rudari said he would also submit written requests by offering concrete evidence.
Taking on this short trial process that we have started now, we are also afraid to raise our hand and present our views regarding this trial process”, said lawyer Rudari.
While accused Almir Abdurrahman's defender, lawyer Faton Fetah, expressed his disagreeing views in relation to the Rudari attorney's proposal, except the head of the court, after considering none of the provisions of Article 39 of the Criminal Procedure Code have been met.
Initially at the hearing, the court's chairman, Medie Bytyqi, announced the parties that by defender Hasan Maharaj, lawyer Arian Koci has accepted the request for delaying today's session and other earlier scheduled hearings, the argument that the accused for health reasons cannot present at these hearings.
In this regard, the case prosecutor, Rafet Halimi, said the attached medical documents appear to be simple guidelines and no particular reason is presented that cannot prevent the accused from attending the session.
Also, indictee Luan Statovci's defender, lawyer Naim Rudari, said that despite each being harmed by the postponement of hearings, however, take into account the fact that the same has filed a request for postponement of the hearing and linked evidence, proposed that today's sessions and other specific sessions be postponed.
At this session, the prosecution was not even accused Salih Statovci, for whom attorney Emrush Kastrati said the same is also missing due to health causes.
Regarding these circumstances, Judge Bytyqi said the Court estimates that conditions for continuing the trial have not been met and that other hearings will be held as scheduled.
Also, she said she will issue a warrant for socialisation for the security of indictees Hasan Magaraj and Salih Statovci for the next session.
However, following developments about the demand for exemption from the subject, Judge Bytyqi said the upcoming hearings were cancelled until the ruling by the head of the Constitutional Court over the request for exemption from the Rudari lawyer, and cancelled the ordinance for the security of indictees Hasan Magyarj and Salih Statovci for social behaviour after failing at today's session.
Otherwise, at the session held on February 10, 2026, the accused was acquitted: Hasan Maharaj, Luan Statovci, Salih Statovci, Kumrije Maharaj, Mejm Zariqi, Sadat Shkodra, Aferdita Gjokaj, Bejtullah Piri, Feriz Jonuzi, Alban Novosella, Berat Nika, Lulzim Hajdaraj, Bajram Gashi, Artan Elezi, Union Mani, Halil Krasniqi, Almir Abdurrahmani, Ingri, Lidon Fadh and Rasim Zeqaj.
The procedure for the two accused, Enver Ibishi and Musa Neveocazi, was singled out. On the other hand, accused Veton Prekazi, Hazir Metaj, Valdete Ismajli, Pajtim Krasniqi, Africa Abazaj and Salih Ilazi have reached agreement on guilty pleas with the prosecution.
Otherwise, criminal procedure in this case has been united into a single subject of “cases Subventions” for 28 accused: Hasan Majaraj, Lujn Statovci, Salih Statovci, Afrim Abaz, Veton Prekazi, Kumrije Mahjaray, Kujtim Zariqi, Sadat Shkodra, Aferdita Gjotaj, Bejtullah Pirar, Ferde, Feriz Jonuzi, Alban Novosela, Berat Nika, Lulzim Hajaraj, Musa Neveoazi, Bajram Gashi, Paj Krasni Krasniqi, Edrin Ebiri, Mani, Union of Mani, Halilzali, Halikıman Almir Abmir Bakrmanimani, Lirjni, Lirqim Hajrjnim Hajdaj, Bakerj and Baker Hajer. /Periscope
