According to the contents of the decision, the event took place on August 31, 2022, between midnight and the clock, at Opija, on Maršala Tita Street, before 135. It's about the parking space of the Crystal Hotel, where there was a personal vehicle of the white-collar Aud brand, Kosovo license plates owned by a Kosovo citizen, reports Fiuman.
The suspect is accused of drawing a black Marker on the cover of the car's engine a cross surrounded by four Cyrillic S letters, and underneath he wrote Cyrillic “Kosovo is Serbia”. With this move, according to claims in the procedure, the car owner has been caused material damage worth about 398 euros, respectively, 3,000 kunas back then.
The particularly important part of the case relates to the fact that the suspect, according to prosecution allegations, has recorded all the action by mobile phone and then published the video in his account in Instagram. The prosecution considers that by this publication he has made accessible to the public content that promotes violence or hatred against a group of people or a member of a group because of their religious, national, and ethnic affiliation, language, and background.
The court's decision finds that the suspicion based on the criminal record of the Primorsko-Goranska District Police, the Court Police Station respectively, as well as the evidence collected, including official notes, photos of damaged vehicles, recordings of crystal hotel surveillance cameras, publication by the Social Instagram network and other materials collected during criminal investigation.
The court also stresses that the suspect has not been found in the reported residence at the Hotel Opatija, that since 29 August 2022, he has not gone to work and has not announced his employer's absence, as well as that he left the accommodation on September 2nd 2022. The same day, according to data from the file, it has left Croatia's territory with public transportation through the Stara Gradisuka border.
The suspect did not answer the prosecution's call for first questioning in November 2022. Later, Croatian judicial bodies through international legal assistance tried to find him, but the competent body of the Republic of Serbia rejected the request. The file also says that the suspect has no registered settlement on Serbia's territory and that national research has been declared against him.
The prison could last more than a month and will be calculated by freedom deprivation day. The court has also decided that detention could be replaced by a 5,000-euro guarantee, provided the suspect promises that he will not hide, that he will not leave the settlement without permission, that he will not prevent criminal procedure and that he will not carry out a new criminal act/express
