Appeal confirms the 44-year prison sentence against five accused of Volljaca's murder in Kline

The parties' polls were released at the March 26th 2026 session, which was held by the College of Judges consisting of Valbona Musliu-Selimaj chairman, Jevdet Abazi Jedazi .

The same appeal also recognises the representatives' claims of the injured party, lawyer Fanol Krasniqi, considering that in the content of his complaint, more is spoken of in the judicial qualifications of criminal acts and that he claims the accused had to be convicted of criminally committing serious murder in co-ordination, rather than released by other indictees, who is considered mild, including all accused.

Also, Apel has found that even the complaints of defenders of the accused, lawyers Emrush Kastrati, Ruzhdi Gashi, Muhamet Ibraj, Guzim Kolcak and Guni Kelmendi are unfounded.

According to Apel, defenders of the accused have not mentioned any other extenuating circumstances that would affect easing the sentence, which means that the Foundation has assessed all the difficult circumstances, and, taking them into account, it has pronounced the sentence on the accused as the device of the complaining decision.

In the end, Apeli points out that given all the circumstances outlined in the complaint decision, the concrete circumstances and the way the critical event has developed, it turns out that the sentence the court has pronounced upon the accused is fair and legitimate, and that the same is in harmony with the intensity of the social risk of the work committed and the degree of criminal responsibility of the accused.

Otherwise, the “Justice Vow” had provided the recording of the hearing to declare the act, where honour Gashi had been sentenced to 28 years in prison, while Basri, Agron, Ardi and Bahri Gashi had been sentenced to four years each for the murder of the F.H., which had occurred in Volljaka in Kline. In all, 44 years of imprisonment had been pronounced in the retrial, since 84 years of total imprisonment had been pronounced in the first trial for the accused.

Following the second decision of the Foundation, “Justice Trust” had reported that the brother of the slain in Volljaca, Kline, F.H., Mahmut Hoxhaj, allegedly injured two people after the Constitutional Court in Pec pronounced 44 years in prison for the five accused in the 2022 murder. He had waited for the victims in the parking lot and shot at two people. The police had immediately arrested him at the scene.

One of the wounded was Basri Gashi, who is charged in the case of Hoxhaj's brother's murder and who on October 17th, after declaring the indictment, was acquitted of the detention measure. The other wounded was A.U., who had gone to take Gashi and others who had been released from custody.

The Basic Prosecutor's Act in Pec, upgraded on February 3, 2023, charged six accused: We honor Gashi, Basri Gashi, Agron Gashi, Ardit Gashi, Bahri Gashi, for “grave murder”, “Heavy attempted murder”, “Non-licement” and assistance in carrying out the criminal work “grave murder”.

According to the indictment, the honourary defendants, Basri, Agron, Ardi and Bahri, on April 28, 2022, at around 20:30, in the village of Volljaca, the Cline municipality, in the parking lot of the restaurant “Villa Park”, prepared in advance and acting in co-ordination with the aim of postscriptulous revenge, deprived of life victim F.H., risking the lives of other people.
