Koci, in his announcement, has said that the raid on Shkelzen Gashi's apartment has been carried out without court orders, until during the raid, he says Gashi has been introduced to a prosecutor's author's authorship for collecting evidence.
This authorization does not replace the judicial decision to raid. Moreover, this document is the international communication of the Special Prosecutor and the Kosovo Police.
According to Article 36 of the Constitution, home raid, seizure of equipment and communication interference are allowed only by judicial decision, except for emergency cases. Such urgency does not exist, especially when dealing with public activities ʹ exhibits in the centre of capital”, Koci writes.
According to defence lawyer “the way the raid has been carried out, the unreasonable haste of state bodies consigns the alleged criminal case from the beginning”.
In the end, Koci says that the case in question also presents dangerous precedents for freedom of expression and public activity.
