PDK: International Special Court Findings Alarm for Injustices Against Former KLA Chiefs · Global Voices

The Democratic Party of Kosovo has expressed “deep concern” over the findings of the organisation's report “Bar Human Rights Committee of England & Wales”, which deals with judicial processes against former KLA leaders at the Special Court in The Hague. “This report of this high-ranking international human rights organization, [...]
“This report of this high-profile international organisation in the field of human rights raises serious concerns about respecting the standards of a fair judgment, highlighting risks of incompatibility with the basic principles of the Council of Europe and international human rights instruments”, the PDK's response reported.
The PDK says the findings of this report “cannot and should no longer be ignored by local and international institutions”. The report named serious challenges to the integrity of the judicial process issues such as human rights violations, long and virtually incompatible detention, restrictions on provisional release, as well as allegations of equality of parties in the process pose serious challenges to the integrity of the judicial process. Concerns concerning transparency of evidence and their source were also stressed.
“The PDK reiterates that the Kosovo Liberation Army's war was fair and liberation. Consequently, any process against KLA members should be untenable on standard, clean in procedure and fair in every respect. We demand that the report's recommendations be taken seriously and urgently, including the creation of an independent monitoring mechanism, which guarantees full respect for international standards and the preservation of the legitimacy of the” judicial process, is said in response.
The PDK calls on the financing states of Specialised Chambers, Justice Experts, Civil Society organisations and all human rights connoisseurs, both inside and outside the country, not to be silent.
The case in front of these findings implies normalisation of low standards and risks creating dangerous precedents for international justice. The PDK will continue to carefully follow all developments and engage in the defense of justice, truth and the dignity of the liberation war of our people. The PDK believes in the liberation's innocence and awaits a final, fair and unremitting decision, which will enable their release and return to Kosovo”.
