Thaci's defence requires the prosecution not to issue new evidence

Hashim Thaci's defence, represented by lawyer Luka Misetiq, has asked the court in the case of former KLA officials, to order the prosecution not to issue further evidence except under extraordinary circumstances. According to the procedural aspect, as presented in the defense setting, on February 18, 2026, the court has closed the case in this court case and has specifically said that in accordance with the 136 rule, money or other evidence can no longer be presented to them at this stage except under extraordinary circumstances.

While, according to the defence, on March 4th, the prosecution has placed three new articles on access to the panel, claiming they are subject to the 103rd Rule. Rule 103 under Procedures and Evidences, is about excusing evidence, which you see:

“Depending on the 107 rule and the 108 rule, the Specialised Prosecutor immediately makes available any information for which he has reason to be believed to suggest innocence, or facilitate the guiltyness of the accused, or influence the credibility or support of the specialised prosecutor's evidence, once such information is under the preservation, control, or actual knowledge of the Special Prosecutor<1>.

The defense says he asked the prosecution to explain that day if he was informing the court of such evidence. While, the prosecution allegedly took similar action on March 10th, placing two other articles on Legal Workflow with the claim that they are subject to the same rule.

The 136 set of rules is clear: when the procedures were closed on February 18, 2026, there can no longer be any more parachutes to the panel and the panel can no longer accept other parads or hear evidence unless extraordinary circumstances require otherwise. The Judgment Panel itself instructed the parties on February 18th 2026 that at this stage no longer can be done in advance or other evidence, in accordance with the clear terms of the 136”, it is said in the defence parliament.

While defence regulations in question prevent them from becoming parachutes or additional evidence, the prosecution continues to do so without indicating that there are extraordinary circumstances.

The defence also says that if the prosecution reveals excusing materials that require reopening the case, then it is up to itself to file a motion in accordance with Rule 136 and to show enough reason and extraordinary circumstances to accept that excusive material as evidence.

For the reasons mentioned above, defense respectfully requests the Judgment Panel to be: U n THROUGHING the SPS not to make discoveries of additional evidence to the Judgment Panel, whether via Legal Workflow or otherwise, unless it can demonstrate enough reason and extraordinary circumstances to do so”, it is said in the defence building.

The Prosecution's closing word began on Monday, February 9, 2026, and ended the following day, on February 10th, where specialised chief prosecutor Kimberly West sought a unique sentence of 45 years in prison for each of the four accused. But on February 10th, the final word was also given by the defender of the victims, Simon Laws.

While on February 11, 2026, he gave his final word to Hashim Thaci's defence and began the defence of Wessel, and continued on February 12th. That same day, Selimi's final statement began and ended on February 13th, the date on which Krasniqi's defence statements later started.

The latter concluded concluding statements on February 16th, which continued with court questions and the responses of defence and prosecution. The Specialised Prosecutor's Office, on September 30th 2022, has handed over the confirmed amended indictment against Hashim Thaci, Kadri Veselini, Jakup Krasniqi and Rexhep Selimi, which consists of ten points of charges, where the latter are charged with war crimes and crimes against humanity.

On April 29th 2022, the Specialised Prosecutor's Office had handed over a amended indictment against Hashim Thaci, Kadri Wessel, Rexhepi and Jakup Krasniqi, where four indictees have committed war crimes even in Gjilan, the Semetish Budakov. On November 9th 2020, in their first appearances, Hashim Thaci's Jakup Krasniqi has pleaded innocent to charges placed on them. Wessel has also been declared in his presentation on November 10th, as has Rexhep Selimi on November 11th.
