Josh: The PDK is the second member of the CEC his appointment from Osman, constitutional offense

“President Osmani, on the 9th letter to President Bedri Hamza, has demanded that we write down the candidate for CEC members. So, not a candidate's proposal, as he has now certified, but candidates, in plural. Therefore, it has the responsibility to explain to citizens what prompted it in recent moments to withdraw from the constitutional and legal path of appointing PDK members in the CEC”, he added.
Joci stressed that the failure of the PDK's second representative to the CEC conflicts with Article 139 of the Kosovo Constitution, where 6 members of the CEC are clearly appointed by the six largest parliamentary groups, respectively, by Albanian political subjects represented in the Assembly, which are currently LVV, PDK, LDK and AAK.
Thus, the Constitution of Kosovo is clear: First, proportional representation of the largest parliamentary subjects is provided. And second, since after the December 28th elections in the Assembly are only 4 Albanian parliamentary groups -- that is, in the absence of sufficient number of 6 groups -- additional members are appointed by the largest parliamentary groups, which in this case are the Vetevendosje Movement and the Democratic Party of Kosovo” -- he explained.
According to Djoshi, this development in addition to violating the opposition is endangering the legitimacy of the elections and democratic standards of the Republic of Kosovo itself.
The Kosovo Democratic Party will use all legal means in search of implementing its right to be represented in the CEC, according to the right given to the Constitution of the Republic of Kosovo”, Joshi warned.
Joci recalled a similar case when President Osmani in 2021 had tried to prevent the appointment of a second member of the CEC.
“In the first year of its mandate, Osmani had tried to find an opportunity to advance the Vetevendosje Movement's constitutional demand for the appointment of a third member in the CEC. But after refusing to address the core handling of the case by the Constitutional Court, it had not dared to approve this requirement, which clearly conflicts with the spirit and letter of the Constitution and would constitute a dangerous precedent for the political capture of the institution of”, he added.
On the other hand, Joshi voiced a second concern that if the Constitutional Court does not return answers as it did in 2021, after April 4th in the post of the first state would be placed as a task officer, Albulen Haxhiu, who could arbitrarily decide that the PDK would not be entitled to two-member representation of the CEC.
“A person with a large anti-unconstitutional and anti-legal luggage, which is certainly ready for capitalising the rotating violation of the Kosovo Constitution and decides arbitraryly that the PDK does not have the right to representation in the CEC with two members, thus forcing us to address the Constitutional Court, which, until it has dealt judicially with the issue, the Vetevendosje Movement would practically commit a host of violations and abuses in organising the election, he said.
He added that with these actions the Vetevendosje Movement is creating opportunities that in subsequent election processes violate electoral laws and regulations.
“We are all witnesses to lawlessness that has been promoted by the Vetevendosje Movement during the February 9th, October 12th and December 28th of 2025 elections, so this party is creating circumstances that in its upcoming elections violate election laws and regulations, making decisions that will destroy the election process and bring about situations when the election results are not accepted. In this regard, it is sufficient to remember the case when the representative of the Vetevendosje Movement in the CEC has publicly threatened (before the media) members of the CEC and with the exclusive name of the member of the Turkish community just because they had supported the PDK representatives' amendment to budget the submission of original ballots for voters outside Kosovo, as provided with the KEC's legal act of registration and voting outside Kosovo.<x1, potenco Joshi.
