Defence calls for release, prosecution retrial against former AKI official charged with corruption

The reference judge, Skender Chocaj, announced that the Constitutional Court in Pristina has sentenced Krasniqi to two years in prison for the criminal work “KEquity of formal position or authority”, meanwhile, has freed “Intelligence of classified information and non-savory information”, reports “The Battle for Justice”, broadcast Periscope.

Chocaj said that against the first degree decision, the Constitutional Prosecutor in Pristina has filed complaints due to essential violations, as well as the wrong and incomplete confirmation of the actual situation, with the proposal that the issue be turned into retrial.

Responding to this complaint, the judge said they have exercised the attorneys of the accused Krasniqi, Florent Latifaj and Fanol Krasniqi, proposing that the prosecution's complaint be rejected as unfounded.

Lawyer Krasniqi before Appeals' college said the prosecution in the complaint has included criminal acts for which the accused have been removed during the phase of rejecting evidence and demanding to cast the indictment.

Lawyer Krasniqi said the entire act of prejudice is based on statements of a witness that has not been eyewitness and has stated in another criminal case.

Likewise, Krasniqi stressed that in this case the damaged party is not known and that the profit of wealth is lacking for the accused himself or anyone else.

Lawyer Latifaj, meanwhile, said he supports colleague Krasniqi, adding that the complaint has been compiled along with him. The accused himself said he supports the attorneys' statements and parliaments.

The session then ended by announcing to the parties that a written decision will be accepted within legal terms.

Otherwise, the second review of the case was held in opposition to the law, as Judge Foniqi had held the session in the absence of accused Krasniqi.

Meanwhile, in the initial review held on March 10th 2022, the accused Krasniqi was declared innocent of criminal acts that he is being charged with under the accusation.

Contrary to evidence, the accused was removed from criminal acts “Photo and other unauthorized recordings”.

The Basic Prosecutor in Pristina, the RS Department of Criminals, on February 23rd 2022, has filed charges against indictees Muhamed Krasniqi, for criminal acts “due to the use of official position or authority”, “KEq use of official information”, “access to computer systems”, “Zultin of classified information and not preserving classified information” and “Photo and other unauthorized recordings”.

According to the first point of the act, the accused Krasniqi, on 17 September 2020, August 25th 2020 and March 11th 2021, at the Kosovo Agency for Intelligence and contrary to the law, as an official in the quality of the AKI official, is accused of overstepping his competencies and failing to fulfill his duties.

The indictment says without authorization it has intervened in the AKI computer system, unauthorising the program for monitoring other computers “Net Monitor for Employe Pro”, from which the program has been infected 55 other computers within the AKI headquarters, and installing the software software software file “Vajon”, where it violated the rights of other employees, creating unauthorized access to the content of the officials had in possession of, as well as misusing its software authorisations (designs) and post-designing the files that it used for obtaining and obtaining information from computer.

With that, Krasniqi is accused of committing the criminal work of using the official position or authority” by Article 414, paragraph 1 concerning paragraph 3, points 3.1. And 3.4. KPC's.

At the second point of the indictment, Krasniqi was charged with using the program “Net Monitor for Employe Pro”, and the software program file “Veyon” , which was documented that they were installed on computers he used in the AKI network, has created access to employees' computers and superiors within the AKI communications network, from which he had access to each infected computer activity, seizures, payment of passwords, video networks, users' activity, arguments, etc.

With that, Krasniqi was charged with criminal work “The use of official information” by Article 416, paragraph 1 concerning KPRK's paragraph 5.

In contrast, according to the third point of the act, Krasniqi by misusing official duty has installed software “Net Monitor for Emplores Pro”, and software file “Veyon”, in the internal communication network of AKI, through his two computers and has created access to 55 other employees' computers via “Agents of the programme”, where he allegedly accessed information from the computer systems of AKI workers, and had the software installed <6m) and installed <XNeplories on his computer, and installed his own computer.

With that, Krasniqi was accused of committing criminal work “accessing computer systems” by Article 327, paragraph 1 of KPRK.

Likewise, Krasniqi, according to the 4th point of the indictment act, having access to classified AKI units documents, which were found on his computer at the AKI facility and computer at his home, is accused of copying and storing those classified documents, which were not required out of the AKI units' classified documents, with a secret and over secret level, general and same file inspector's documents, accused of copying and storing those classified documents, which were not to be released out of the environments, and accused of being given criminal information: Agim Krasniqi, Aif Krasniqi and Arif Krasniqi, who have been investigated by police because of suspicion of criminal acts.

For this, Krasniqi is charged with criminal work “Intelligence of classified information and failure to store classified information” by Article 125 of KPRK, concerning Article 50, paragraph 3 of Law No. 03 L-178 for the information classification and security verification.

While, according to the indictment's fifth point, Krasniqi was accused of misusing his official duty and misusing the information he had about the AKI video-monitoring system, the same is accused of being introduced into the video-monitorial system and has made the unauthorised photographic photograph of at least two officials within AKI objects.

For this, Krasniqi was accused of committing criminal work “Photo and other unauthorized recordings” by Article 202, paragraph 1 concerning KPRK paragraph 3.
