Aiden Ellis, Jakup Krasniqi's lawyer, told the court that his client would have to be acquitted when judges implement “with rigorousity the principle of burden testing”.
The lawyer said the specialised prosecutor at The Hague, from the way he has cleared the case, is seeking the condemnation of the Kosovo Liberation Army's General Staff.
“The whole essence of personal responsibility is that each of the accused's contribution should be individually identified for each of them, because if it is sufficient to rely on membership in the General Staff, then it is essentially due that the issue is against the General Staff, not against the accused individually”, he said.
He proved faithful that judges would agree to “the arguments set forth” by lawyers, and Krasniqi would be declared innocent. /Periscopi
