According to the Constitutional Court's act in the case of KO79/23, reducing the pay for public officials during the first 15 years of career does not match the Constitution. The court had ordered the Kosovo Assembly to change the provision for paying labour experience at least 0.5%, with an effect from February 1st, 2024.
However, IKD points out that the World Trade Division Bill for 2026 does not respect this deadline. Article 31.2 of the bill envisions increased basic pay on the basis of work experience starting on 1 January 2026, two years after the Constitutional Court's deadline.

The institute calls on the Speaker of the Parliament and MPs not to adopt the Bill in this form, but to push Article 31 off and undertake the necessary legal changes to the Law on the Criminals in the Public Sector, ensuring the retroactive return of means from February 1st 2024.
The IKD analysis comes as a warning for respecting constitutional principles and protecting the rights of public officials in line with Constitutional Court decisions.
