At this stage, we aim to call 12 witnesses, of whom 11 will expect to bear witness in the courtroom. However, we are now able to confirm only three witnesses. One of the witnesses is expected to give testimony to the viva-voce... Now that we're talking, we have a witness. Another witness has been released to witness under Rule 154. Now the next witness to be released is under Rule 153. I would say that for most of them, if not all remaining witnesses, we expect to make requests according to Rule 154, but that also depends on getting authorization from the recipient of information or witnesses”, Misethic said.
While, Aiden Ellis representing Jakup Krasniqi, said they aim to call only five witnesses.
There are five overall “Two of whom we expect to appear by rule 154. Two under Rule 153 and one under Rule 155”, Ellis said.
On the other hand, Misetic said they expect authorisation for 30 documents under rule 170. He said they have witnesses who belong to treatment according to this rule.
Unlike Misethic, Ellis said that they have no witnesses according to this rule, but parts of the documents. He said it's about five documents they haven't received yet.
Lawyer Misetic added that statements that are submitted according to the 145th rule that the SPS should be given have already made.
Judge Guénawel Metttraux asked Misetic that in case they don't get authorization for either of these witnesses or some of them until August 18th, 2025, what is their plan.
Misetic said it's a matter of interpreting the 107th Rule, which has asked for an opinion, but has not been answered. He said that until he gets answers, he won't make any names.
I don't want to take advantage of this vague situation and extract information that shouldn't be extracting”, Misethic said.
He said that if they fail until August 18th to obtain authorisation for these witnesses, they expect the tribunal to assist them with relevant authorisations.
“As of the 18 August deadline, my goal is if we don't hear anything from them, you will receive requests from us to help you with relevant authorization, and that will happen before August 18th”, Misethic said.
Responding to the questions of Judge Fergal Gaynor, lawyer Misetiq said they are in contact with information providers under the 107th rule, and with most of them there have been verbal communications.
“One of them is not very cooperative, but I think he's more careful not to agree with the” process, Misethic said.
