The Appeals Court has confirmed the indictment filed against former Kosovo Energy Corporation chief Nagip Krasniqi.
Krasniqi's defender had applied for dropping the charge of abuse of office or official authority, but the same demand was rejected by the two instances of the judiciary.
The Special Department of the Court of Appeals with the SP's decision,67/24, dated 05.12.2024, has rejected the request for the dropping of the indictment and objections to the evidence of Ngapi Krasniqi.
Appeals ' reasoning states that there is no evidence that can be considered unacceptable or that has been assembled in opposition to the KPP legal provisions, as well as that none of the legal grounds have been identified that could justify the exclusion of evidence, as required by Article 243, paragraph 1, subprefigure 1.1, 1.2 and 1.3 of the KPP.
Therefore the indictment for criminal acts misuse of official position or authority in succession, from Article 414 paragraph 2 concerning KPRK Article 77 against Nagip Krasniqi, remains in force.
