Wessel's lawyer: Prosecutor's acting as a defence lawyer, group of documents have come from Belgrade

In Kosovo Specialised Chambers ( DESK) in The Hague, on Tuesday, continues testimony to Sylejman Selimi, who is the 121st witness in the judicial process to Hashim Thaci, Kadri Veselin, Rexhep Selimi and Jakup Krasniqi. During his objections to accepting some documents on material evidence, Wessel's defense represented by the lawyer [...]
During his objections to accepting some documents on material evidence, Wessel's protection, represented by lawyer Rodney Dixon, said the prosecution is acting as a defence lawyer, reports “Justice Vow “.
He added that many documents have come from Belgrade and that the Prosecutor must find the person who has brought them and their origin.
This is a bunch of documents that have come from Belgrade. We do not know what chronology is, some documents have been accepted, and the witness does not directly relate to documents that have not been accepted. The prosecution must follow the correct procedure, find the person who has brought the documents and find the origin of the document, but this is not the witness who can be used to accept these documents. That's not the right way. It's already earlier that the prosecution is acting as a defence attorney”, Dixon said.
Initially, when asked about a person named Zarko Milograsac, witness Selimi said it is the first time he has heard of him.
As for Miroslav Sulenic and Dejan Stojkovic, the witness was not heard what he answered.
According to prosecutor Matt Halling, a material test showed Vladimir Spasac being taken to the “Plemby” and sent to Sahit Jashar as commander of the Military Police at Drenica Operative Zone (ZO).
I don't know if there's any such case. I can't remember there was any such case”, the witness said in this regard.
Later, the prosecutor asked what measures were taken by the military police commander in the case there would be such transfers from a unit's workshop to the ZO Military Police Commander of Drenica.
I didn't hear you say there was a case like this. I don't know what would happen, but I don't know if there is any such case that has been recorded or I don't know”, Selimi said.
The prosecution insisted on his question, seeking to show that in similar cases what would happen.
“I don't know there was any sanction for such a case or similar case”, said witness Selimi.
While prosecutor Halling again asked whether there were bases in the Drenica Operative Zone for handling such cases.
I'm saying this is the case I don't know that happened”, the witness Selimi insisted.
As a result, the prosecutor placed the witness with a film material showing Zarko Milograssic, Miroslav Sulenic and Dejan Stojkovic showing up in different video segments.
There were questions on the video like “when you first heard about it KLA? Who's the KLA for you? What do you think of the Albanian people? What do you think of Serbian politics? What do you think of Slobodan Milosevic? What do you think of the Serb police massacres exercised on the Albanian people?”
One person gave answers to these questions in the Serbian language. While the prosecutor provided an explanation for the video and the statement of the person who spoke in Serbian.
This video has the same questions that appear in materials directly related to your area and the Military Police. This man is claiming to have been imprisoned there and you've been the commander of the area there and you're continuing to say you haven't had knowledge that such things have happened”, Halling said.
It's not like it's in Drenica, but it's also in Drenica, which is the first time I'm listening. Even these questions I don't know who wrote them on this sheet and who has asked those questions as I told him before, said witness Selimi.
He says from the moment the KLA stopped me. It's part of a video of people given to Sahit Yashri- commander of the Military Police that you said was stationed in Licoc and you say you don't know this happened”, the prosecutor said.
“Ay is writing, but it must be more and more days when it is recorded”, the witness said away.
Selimi was asked whether he was sentenced by EUEX for subject “Drenica 2” for stopping people in Licoc. However, those questions contradicted the defense of Kadri Wessel, lawyer Rodney Dixon.
I object to this lead of questions that a defense attorney appears to have appeared here. This is the prosecutor, and he's asking questions to a witness, and he's a witness to the truthfulness of content. I object to the way questions are being asked”, Dixon said.
However, Rodney Dixon's opposition to the court collapsed, and the prosecutor continued with his questions on the case.
Later, Selimi was asked whether the sentence was appealed and whether he went to the Supreme Court, but the witness's response was not heard.
When asked to accept some documents on material evidence, Dixon declared that the documents came from Belgrade and demanded that the person who brought them and the origin of the document be identified.
As a result, the chairman of the court, Charles Smith III, said that these documents would receive a number of provisors and would later be established for their compliance.
In contrast, at the beginning of the testimony, a document was presented that he said contained his handwriting (Selim). Prosecutor Halling focused on a piece of writing that was unreadable, for which witness Selimi said his name and deputy Sami Lushtaku were written. Also, in one section, it read “101” that was his figure during the war.
According to the prosecutor, modern weapons and high-caliber means were required in this document.
“I don't know, but at the beginning of the war they were known and nobody was taken with them, even though there was”, the witness said when asked whether Slobodan Milosevic's support Kurti was.
That is how prosecutor Matt Halling's questions ended to continue later with Hashim Thaci's defence represented by lawyer Luka Misetic.
Part of the session took place closed to the public, while prosecutor Halling posed questions for witness Selimi.
At the beginning of the session, due to lack of information and its origin, and also the fact that the witness was unable to speak of it, the court refused to accept in material evidence a document the SPS said was obtained from an open source on the internet.
Nor was another document accepted with the same reason that the witness did not know about him and the contents of that document.
Judge Smith announced that the four defendants are present at the courtroom. It is also noteworthy that today's session has been with many technical problems in broadcasting.
