31 years in effective prison, 6 on bail and 171 thousand euros in fines against 11 indictees in the “case. Subventions 1”

The Constitutional Court in Pristina has declared bias against 12 indictees in the “case Subventions 1” 11 of them, the Court sentenced them to effective prison terms of 31 years, 171 thousand euros in fines and 6 years in prison on bail (both). The indictment was proclaimed Thursday by the chairman of the court, Kujtim Krasniqi.

The accused: Luan Statovci, Sadat Shkodra, Salih Statovci, Berat Nika, Hasan Maharaj, Zorim Zogaj, Jeton Sylaj, Lulzim Hajdaraj, Musa Neveoazi, Almir Abdurrahman, Africa Abazaj and Florim Nimanaj were tasked with criminal acts “Repurge”, “Disuse of official duty or authority<3>, <x>Medocy out with subsidies<5> and other.

According to the indictment, Luan Statovci was found guilty of “taking bribes” in co-ordination and continuing, and sentenced to 8 years in prison and 50 thousand euros in fines.

Sadat Shkodra was found guilty of “taking bribes” in co-ordination and continuing, and was sentenced to 6 years in prison and 20 thousand euros in fines.

Berat Nica was found guilty of “taking bribes” in co-ordination and ongoing succession, and sentenced to 6 years in prison and 20 thousand euros in fines.

The Zogaj surrender was found guilty of “Taking bribes” and sentenced to 3 years in prison and 5 thousand euros in fines.

Hasan Magaraj was found guilty of “Repression with subsidies” and sentenced to 3 years in prison, reports “Justice Vow “.

Musa Neveocazi was found guilty of “duty fraud” -- a work carried out in co-ordination and sentenced to 2 years in prison, which would not be executed unless the accused in the three-year term committed a new criminal act. The same is pronounced fine sentences of 10,000 euros.

Lulzim Hajdaraj was found guilty of “duty fraud” -- performed in co-ordination, and sentenced to 2 years in prison, which would not be executed if the accused in the three-year term failed to perform another criminal act. Hajdaw was also awarded fine sentences of 10,000 euros.

Salih Statovci was convicted of assistance in “taking bribes” and sentenced to 5 years in prison and 25 thousand euros in fines.

Almir Abdurrahman was found guilty for “Forging” documents and being sentenced to 25 thousand euros in fines.

Florim Nimanaj was found guilty of “Payback” and sentenced to 1 year in prison, which will not be executed if the accused in the two years' verification does not commit a new criminal offence. He was also sentenced to 3 thousand euros in fines.

Africa Abazaj was found guilty of “Help to bribe” and sentenced to 1 year in prison, which will not be executed unless any other criminal act has been committed in the two years' time. He was sentenced to 3 thousand euros in fines.

The accused Luan Statovci and Sadat Shkodra, the court, imposed a complete sentence -- a ban on the exercise of public office in public administration or public service in the term of 10 years. On the other hand, Zogaj -- Berat Nikaj, Musa Nivokazi and Lulzim Hajdright -- supplementary punishment - stopping the exercise of public office in public administration or public service for five years.

But the accused: Sylaji lives for “Kestum use of official task”, Hasan Maharray for “You have made use of the official task” and Salih Statovci for “Observation in co-ordination” and continues to be cleared of charges after it has not proved to have done this criminal act.

In the prison sentence, the accused were also counted as past time in detention.

However, if the accused cannot pay the fine sentence, the same was replaced by prison, where 20 euros of fines are accounted for in one day.

The accused are charged with paying exclusively 300 euros, while on behalf of the crime victims' compensation fund from 100 euros.

The court ordered the permanent seizure of criminally acquired items and used to carry out criminal acts. The accused Salih Statovci confiscated 200 thousand euros and a phone from accused Berat Nica two phones, from Sadat Shodra a phone. The return of the car in the name of A.M., accused Magyarj two Samsung phones, Birding a phone.

The damaged -- Ministry of Agriculture for the realisation of the property-juridic demand is directed to regular legal-civil disputes.

Against this act, complaints are allowed in the 30-day term at the Court of Appeals.

In February 2022, The PSRK had filed charges against 21 defendants in the “case. Subventions 31x1>, which are: Luan Statovci, Sadat Shkodra, Salih Statovci, Berat Nika, Hasan Maharaj, Akim Zogaj, Habibe Dauti, Alban Bushati, Jeton Sylaj, Lulzim Hajdaj, Musa Neveoazi, Almir Abdurrahman, Salih Kelmendi, Bekim Shala, Fuat Morina, Dukagjin Mavrej, Flamur Zeqiri, Daut Kabashi, Kastriot Berisha, Akrem Abazaj and Florim Nimaj.

Otherwise, at the February 21st 2023 session, the court had phased out the procedure for indictees Neveokazi and Kelmendi, adding that the court in the next session will assess whether the procedure will continue separate or join.

Meanwhile, at the April 14th 2023 session, criminal proceedings against accused Neveokazi had joined.

At the April 13th 2022 session, the Constitutional Court in Pristina had accepted the plea agreement for 7 out of 21 accused in the “case. Subventions 1”

And on April 19, 2022 The Constitutional Court in Pristina had declared a conviction court against seven indictees in the “case. Subventions 11”, Alban Bushati, Kastriot Berisha, Bekim Shala, Flamur Zeqiri, Habibe Dauti, Dukagjin Mavray and Daut Kabashi, condemning them to 6 years and 1 months in prison and 2 thousand euros in fines.

According to the amended SPRK indictment of April 4th, 2022, Flamur Zeqiri, Bekim Shala, Kastriot Berisha and Dukagjin Mavraj were charged with criminal acts of subsidies, abuse of office or official authority against Habibe Dauti, for taking bribes and forging documents accused Alban Bushati, while bribery accused Daut Kabashi.

Fuat Morina after accepting guilt, on June 2, 2022, was sentenced to 6 months in prison for the criminal vise <x) Also, the same has been confiscated by 27 thousand euros. For Salih Kelmend, however, judgment is ongoing.
