The Council for Freedom of Conditions, consisting of Agim Maliqi- leaders and members of Burim Ademi and Besim Zlatshi, on August 7th 2024 had made a decision on the bail release of Gashi, who was in pain of punishment for causing general risk and illegal weapons. The decision to release him has been taken eight months and 19 days before the sentence ends.

Premim Gashi, dead on September 1st as a result of gunfire between families “Sekiraqa” and “Gashi”, known as the Capat.

In the decision of the panel, provided by “Justice Trust”, Gashi's promise was said to be released from August 13th, 2024, and be under surveillance of the Kosovo Sprovatory Service by April 26th 2025.

Also, with the approval of Gashi's request for parole, the same was required that within five days of release from the correctional institution be announced to the Kosovo Regional Police Directorate and the Sproving Service under certain conditions.

“1. regularly report to the Sproving Service by 26.04.2025; 2 in case the shift of residence announces the Police and the Sprovatory Service; 3 does not attempt to travel abroad without the approval of the Commission for Freedom with Condition; 4. Be more careful with its conduct in the future”, says the PLK's decision.

Initially, the panel's decision stresses that Gashi had been convicted and sentenced to 1 year in prison and 500 euros in fines from the Constitutional Court in Pristina for criminal acts: “Cause of general risk” and “holding ownership, control or unauthorized possession of weapons”, this decision taken by Judge Nushe Kuka-Mekaj.

However, Appeals had stiffened his sentence by increasing its height for six months -- totally condemning him to one year and six months and to a thousand euros fine -- a decision taken by the judges' college with Tonka Berisha-chairman and members of the Union of Hyseni and Vaton Dorg.

Apel's decision had also proved the Supreme one by rejecting the plea for easing the sentence on Gashi. The third-instance decision was made by the judges' college made up of Judge Merem Memaj-chairman with members of judges, Africa Shala and Valdete Daka.

Then, reportedly at the panel session, the summary report of Kosovo's professional corrective Service team was considered, and following the assessment of data presented in this report, the panel has found Gashi to be sentenced to one year and six months in prison and that he has even eight months and 19 days in prison.

“In the legal report for the convict proves that the convicts, the date of the end of the sentence, 2604.2025 and the count of the sentence, have been sentenced to prison terms of one year and six months, have remained eight months and 19 days, which will be monitored and controlled by the Kosovo Sprovatory Service”, the panel ruling says.

In addition, according to this decision, from reports compiled by the Team of the Correcting Centre, results in Gashi's showing good behaviour, reduced the risk of recicivilism, that he has admitted to regret the work, claiming they have reached reconciliation with the damaged family. Furthermore, that team had estimated that the convict has shown positive elements of resocialisation.

The panel during the session found that there are no records of disciplinary violations, that it has been engaged in work and that Panel has also received on the basis of the promise Gashi had given officials of the Sproving Service that he will co-operate with them until the completion of parole supervision.

Also, the panel had estimated that the same with effective oversight would be re-integration into households and society in accordance with the law, and that the time spent in prison under the panel has achieved the purpose of the sentence under the Law for the Execution of Criminal Sanctions.

In the end, the panel had decided that Gashi would be released on bail on August 13, 2024, at 4: 00 p.m. under the conditions mentioned above.

But, just 19 days after his release, he was left dead from gun shooting in Aktas- in Pristina.

Otherwise, the “Justice Vow” on Tuesday exclusively had reported on the contents of the Constitutional Prosecutor's request in Pristina for the detention assignment, which was described in the actions of suspects who led to Gashi's death and the injuries of five other suspects.

The Constitutional Court in Pristina on Wednesday has assigned the detention measure of 30 days: Korab Gashi, Valdrin Ademi, Robert Llumnica, Salih Sekirakus and Fatos Abbas. /Betimy for Justice
