The initiative for Progress (INPO) has identified procedural violations in the case of the assessment and reporting of the participating parties in the tendering process “construction of Infrastructure in Industrial Park in Livadica, Podujevo” activity announced by the Ministry of Industry, Trade and Trade (MINT) on the date 05.06.2024 and the projected 3,882,1500.
As INPO reports, the ministry led by Roseta Hajdari, in the quality of contracting authority (AK), has failed to make the decision in time for the results of the bidding assessment in this tender process. This decision was issued and published after 71 days, and only after INPO's request to this ministry, no matter what this would have to be made ex-anicio, according to Article 54 of the Public Procurement Law, Article 40 par.3 and 45 par.32 of the Public Procurement Act.
“Reference to these provisions, whenever a contractor authority eliminates a candidate or tender from further participation in procurement activity, such contracting authority must immediately inform the candidate or tenderer of this fact. The announcement of authority's decision to examine, assess and compare tenders should be carried out within the shorter period, not more than 30 days of opening bids (the 40th Entine of the Order). After adopting the assessment report by the ZPP, AK will prepare and publish Formulinary B58 AK Decision Notification Equipment platform.
In this regard, we estimate that effective failure to implement the evaluation and publication procedures creates difficulties for economic operators in recognising the results of their opening bids and the status of their subjects. Therefore, INPO requires that MINT review these practices in order to provide full information to all interested parties, as well as to avoid procuring procedures”, it is said among other things in the INPO announcement.
