In question, the Kosovo Institute for Justice (IKD) has submitted comments to the KKP. Welcoming the address of part of the comment, The IKD found that the draft presented for the vote at the KKP continues to not guarantee proper transparency of the process and creates inequality among Council members, failing to follow the adequate standards adopted by the Kosovo Judiciary Council in proportion to the process of appointing mayors of courts.
The release reportedly in comments sent, The IKD recommended detailing obligations related to transparency so that processes for the chief prosecutor are transparent to the public, candidates for chief prosecutor and prosecutorial system staff. Such detail does not contain the draft that has been submitted for approval to the KKP, which contains only general provisions regarding transparency. Such provisions leave vast areas of interpretation and arbitrariity, which then turn into lack of transparency, this continuing problem of these KPK processes.
In order to assess the candidates' appropriates, The IKD recommended the possibility of taking thoughts or information with character advice from each prosecutor for each candidate for the chief prosecutor. In contrast to KDP, the KKP did not receive this comment on its basis.
According to Drift Order sent for approval, the chairman of the Accounting Panel will be the KKP chairman. The IKD in the given comments has recommended that the KKP establish the rating panel and with the decision appoint the leader of this panel, not specifying that the KKP's chairman should automatically be the chairman of the Accounting Panel. Giving such a task presents uneven treatment between members of the KKP and its chairman, who is “first among the equals”. Even in this case, the KKP did not take over IKD recommendation and follow the KDP line.
On the other hand, at today's meeting, in order of the day is also a review of the decision on the wage of non-propetitive KP members. On this decision, The IKD recommends that the KKP have increased attention, respecting legal provisions and principles. The decision made by the KKP should by no means serve as a discouragement for non-KPK members. This fact would only reinforce the level of corruption within the KKP, as an approach which for non-prosecutor members would potentially be meant as exclusive.
