The Kosovo government has not yet taken any concrete steps to establish the genocide indictment against Serbia. That is how law connoisseurs, who also stress that Kosovo has no subjectivity for exercising this indictment.
Although Kosovo Prime Minister Albin Kurti had declared in May 2021 how the government has begun work on presuming the indictment, the issue is now silent and no information from the executive in this regard. Kosova Preress has been asking questions for the Office of the Prime Minister and the Ministry of Justice on this issue for days, but the latter have returned no response until the text is published.

International Criminal Law Professor Ismet Salihu considers that this mandate is not expected to happen, even stressing that Kosovo needs three more years of work in this direction.

Importantly important, according to the criminal law professor, is that work for the establishment of the indictment should be done institutionally. Professor Salihu considers Kosovo has been delayed for no reason in exercising the genocide indictment against the Serbian state.

From the Fund for Humanitarian Law in Kosovo, Amer Alija declared for Kosovo that for the realisation of the genocide indictment against Serbia, the Kosovo government has made no concrete steps.

He considers Kosovo has procedural obstacles to file such an indictment against Serbia, since Kosovo is not part of the United Nations of America, according to him.

Even Albana Hasani from the Fol Movement estimates that Kosovo does not have subjectivity for presuming the genocide indictment at the International Court of Justice. Hasani claims that seeing the complexity of this issue as it is hard to say it has also been done for votes on the part of Prime Minister Albin Kurti.

Months for looking into an interview for Kosova Prees, Deputy Justice Minister Vogan Qrolli had declared that since Kosovo is not a member of the UN, they are looking at opportunities for another state to eventually release this indictment in DND.

He had said that Kosovo will make all preparations and is making every day through the Institute, through the ministry of justice and through its institutional mechanisms, but Kosovo is currently not a member of the United Nations and is not a party to the International Court of Justice statute.

In Kosovo in the last war, about 13 thousand and 500 people were killed, until, according to the Fund's data, the bloodiest month was April 1999, mostly massacres, with over 4 thousand people killed.
