Sekiraqa continues to remain on the run despite a decision by Appeals that had turned him into detention after first scale had set him free when he had declared the punishment act against him, reports the “Justice Vowy”.
In the 156-page act of the Constitutional Court in Pristina, on charges of inciting the murder of the late policeman Triumf Riza, statements of about 40 witnesses and the management of 85 material evidence are included, reports the “Justice Bettim”.
According to the tribunal, the conflict that led to Riza's murder began in 2000-2001, when he, as Kosovo Police official, was threatened by Enver Sekiraqa.
Always in accordance with the trial, Sekiraqa and his associates repeatedly persecuted Riza, first venturing and burning the tires of the car, followed by armoured vehicles, and burned the car “Land Rover”
The court has found that the rivalry escalated when Riza defended a woman with whom she had begun a love affair, causing Sekirasha's revenge.
The other finding is that Sekiraqa got involved in an armed conflict with Riza and his friends in late 2005, and again in 2006 after an incident at Ferizaj.
According to the court, two weeks before the assassination, Sekiraqa organised an assassination to crash Riza's car in the village of Stagova.
It is found that three days before the assassination, Riza was conveyed by Sekiraq associates who reported each movement.
The court finds that on August 30th 2007, Riza's murder was organised in detail, where the A.B. handover, at Sekiraqa's order, shot him eleven times, fulfilling Sekiraqa's revenge.
The court has stressed that police officer Triumf Riza was killed, the author of the assassination was Arben Berisha, and involved in the murder was F.A., given the Supreme Court of Kosovo's act of judgment, reports “Justice Vowtim”.
The court has also clarified that even the Supreme Court of Kosovo, in its ruling against Arben Berisha, has confirmed that the assassination has occurred for Enver Sekirafis revenge motives against Triumf Riza.
So the court also confirms a fundamental fact in the course of the event, that with the Supreme Court's conviction it has been found that the murder was organised and that two workers who worked for the E.S. were now sentenced to being included in the nickname “Rr” of “> <x3L” who were on the run because of this murder,<5>, is said to be on trial.
The court in its final ruling has concluded that Sekiraqa stands behind Riza's murder.
The court has also cited international cases such as “Albert vs. Italy” and “Lisica vs Croatia” to support its decision based on circumstantial evidence.
In the end, the court has appointed a 25-year prison sentence through which Sekiraqa must understand the importance of criminal acts and reflect that it no longer causes future forbidden acts.
The ruling drafted in this case appears to have been made by the second member of the court, Judge Arrenjm Arren after the chairman of the court, Judge Agim Kuci, had been sponsored by the Kosovo Judicial Council after in the declaration of the trial he had released from house arrest measure Sekiraq, which the same had subsequently escaped.
Otherwise, the Supreme Court of Kosovo had considered the decision to return Sequirah to custody on the part of Apeli as legitimate with the reasoning that he could avoid and escape.
“Justice Trust”, on May 25, 2024, has published research “Sekiraqa vs State”, where it was shown how Sekiraqa was released while now being considered a fugitive.
Indictee Enver Sekiraqa, on May 3rd, 2024, after returning the case twice to the retrial was sentenced to 25 years in prison for inciting the murder of police officer Triumf Riza.
The Constitutional Court in Pristina, for the second time on September 16th, 2019, had convicted Enver Seker Sequirah of inciting the murder of former police officer Triumf Riza and had pronounced him a 30-year term sentence.
However, the Court of Appeals on March 6, 2020, had decided to approve Sequirah's defense complaint by turning the case for the second time into retrial, as according to Apelit, the first degree of judgment was taken in violation of criminal procedure provisions.
The session for the same case was condemned on May 17, 2016, for two counts of criminal action for “in inciting serious murder” and for the “dyrim” with a unique sentence of 37 years in prison, and had been released for criminal work “rape”.
In April 2014, the Special Prosecutor of the Republic of Kosovo had filed charges against Enver Seker Sequirah for three criminal acts, for inciting the murder of Triumf Riza, <x0detyrim” and “rape”, where the first-degree court had declared him innocent.
The prosecution claims the incident occurred in “Swiss Casino” between Sequirah and Riza was one of the motives that led to the killing of Triumf Riza.
Sekiraqa has repeatedly denied that she had a role in Riza's murder until she had declared the charges against him to be political.
