Although about three months have passed since the Ministry of Justice indicated that some of the biological evidence for the Banjska case has been sent to Finland for examination, it is still unknown whether the same has ended or their results have returned to Kosovo. This ministry has not detailed, saying that the answers should be sought by the Prosecutor, who even this time offered no answers.
In just a few weeks, it's been a year since Kosovo faced one of the most serious attacks organised by an armed group of Serbs led by Milan Radojic.
For more than 10 months, the Special Prosecutor is investigating the case, but has never told of the investigation's performance. During May, the Justice Ministry (MD) indicated that biological samples found in Banjska, allegedly belonging to those in the group, were sent for examination in Finland.
These samples were sent to the Nordic state, because Kosovo has not activated the toxicology laboratory.
But the MD has not indicated whether they have completed examinations of the evidence sent, saying that we should address the Prosecution, the institution that has not yet returned.
On your request, please address the competent institution in this case, Prosecution”, says the Ministry of Justice.
On the other hand, the Committee for Jury and Political Studies says the prosecution should announce the course of the case, without revealing details considered confidential, while waiting for the indictment to be established as soon as possible.
When we may have an indictment, the deadlines are set with the Code of Procedure, but we appreciate that it's good to have an act on Banjska as soon as possible. More important than that is that this indictment is as well based on evidence, and which argue the involvement of Milan Radoichicin and include his group in the Banjska event,” declared Liridon Salihi by GLPS.
Salih further says that each institution must fulfil its responsibilities to facilitate the work of prosecutors, so that this indictment manages to pass all filters.
“The question of comments and aspect of the conditions on which prosecutors should work, and of institutions for adequate or potentially facilitate the investigation remains the responsibility of institutions, whatever it is. But most importantly, these investigations should be conducted professionally and have evidence based”, Salihi added.
The complex praises the case to attorney Naim Rudari, who says the prosecution will need more time to investigate the case.
The pre-accession criteria for the accused at the initial session and that of the main review can be rendered. So in the concrete case at least the leader of this group, Radoic, and the others will be charged with committing a serious murder. And now I don't know if genocide and other works will be fulfilled. The works to be loaded on are extremely heavy and without any obstacle will be allowed trial in the absence of”, Rudari said.
On 24 September last year, the group's armed attack, led by Milan Radojic, was killed by police officer Africa Buxaku. /Dukagini/
