Kosovo's government has rejected Serbia's demand for co-operation in the Banjska case and provided evidence for fugitive Milan Radojic.
In a response to Dukagjin, the Justice Ministry said it estimates that Serbia's request is in conflict with Article 85, paragraph 1, subparagraphers 1.2 and 1.3 of the Law on International Jury Co-operation in Criminal Affairs.
Also, according to the Republic of Kosovo Criminal Procedure Code, only Kosovo judicial bodies have jurisdiction to investigate and judge cases allegedly carried out within the territory of the Republic of Kosovo”, it says in response.
The ministry, led by Albulen Haxhiu, has clarified that initially Serbia was the one who refused to co-operate in the case, since suspects of the terrorist attack in Banjska, according to Kosovo authorities, were trained in Serbia.
“After the Serbian terrorist attack in Banjska, given that the terrorists were trained in Serbia, had planned the attack from Serbia, had come from Serbia, following the attack had fled to Serbia, the leader of the terrorist group had publicly acknowledged that it was behind this attack, the Special Prosecutor of the Republic of Kosovo through the Department for International Co-operation of Justice of the Ministry of the Republic of Kosovo, had filed a request for mutual judicial assistance in Serbia, through which it had requested the collection of evidence”, the MD explains.
But, the October 5th request of Kosovo Special Prosecutor 2023, sent through channels highlighted at 3rd of the bilateral agreement in force, Serbia has never responded.
Serbia must respond to demands to hand over criminals so that they can respond to justice in the Republic of Kosovo. An international investigation should also be made in relation to terrorist training bases on Serbia's territory, Serbia's involvement in financing and weapons supply of terrorists”, the MD's response concludes.
US Ambassador Jeffrey Hovenier said a day ago in an interview for Radio Free Europe that Serbia has officially asked Kosovo to hand over whatever evidence they have in the Banjska case so they can prosecute Milan Radojcicin.
The American diplomat said he hopes Kosovo will respond positively to this request in order to ensure prosecution and the responsibility of perpetrators of the criminal act.
