The prosecution seeks the war crimes indictee's sentence, Ekrem Bajrovic.

At Wednesday's session at the Constitutional Court in Pristina, the final word has been given in the trial for war crimes against indictees Ekrem Bajrovic, under prosecutor Ilir Morina demanded the prosecution's sentence, while defendant Bajrovic's defence, lawyer Lubomir Pantovic sought his release from the prosecution. Prosecutor Morina proposed that the accused be found guilty of the criminal offence he is charged with and that criminal sanctions be pronounced in accordance with the law.

The prosecutor of the case delivered the final word in writing and during its publication, said that after the trial management and hearing of witnesses, evidence has been proved that the accused is guilty.

“The actual situation regarding the accused Bajrovic is confirmed by witness data statements: Naim Elshan, Sami Shalaj, Azem Tuzi, Florim Gashi, Becir Zogaj, Mentor Mavray, Tahir Shalaj, Skender Racaj, Agron Zogaj, Ylber Lipa, Ahmet Rexaj, Adem Gecaj, Ademi Beciray, Ramiz Zeqiray, Ibrahim Shala, Naim Tuzi, Riza Mavray, Bajram Dautaj, Is Kikaj, Chief Berisha, and Daut Elan<1> said the prosecutor, Morina.

According to the prosecutor, investigations have confirmed that the defendant committed criminal acts “murder, torture, inhumane behavior, causing great suffering or violation of body integrity or health“, which is one of the criminal acts listed by Article 142. KPRK's.

The prosecutor proposed that during the detention of the accused, he should consider all the relief and protracted circumstances before him in Article 41 paragraph 1 of RSP, (applicable law).

“As critical circumstances to take into account the extent of criminal responsibility ... while as extenuating circumstances the fact that the accused had saved the life of Ahmet Elshan and several others on the day of the murder in the village of Staradrana”, Morina said.

The same proposed that the accused continue his detention until the full might of this act.

In the end, prosecutor Morina said he stands near the indictment and proposes to the court that the accused Bajrovic plead guilty and condemn him by law.

Witnesses present claimed to stand by the prosecutor Morina's final word, while those injured in implementing the property-juridic demand were instructed in law-civil disputes.

The hearing continued with the release of the final word by indictee Bajrovic, lawyer Pantovic.

According to the lawyer, regarding witness statements, the lawyer said the same one had never mentioned the time period when the accused had carried out actions as claimed by the prosecution, and none of the witnesses said he was part of the Serbian paramilitary army.

In addition, according to lawyer Pantovic, the accused had only been a police officer, of a lower rank.

Pantovic said his protector Bajrovic, if he was guilty, would not have returned to live in Kosovo.

The real criminals have fled Kosovo. No one who killed during the war in Kosovo has dared stay in Kosovo ... criminals dare not return to Kosovo and let them live in it anymore, said lawyer Pantovic.

The lawyer has asked the court to protect him, according to Article 363, KPRK's 3 point, to free him from prosecution.

Meanwhile, the accused Bajrovic said he stands in whole next to his defender's final word, as well as added that he does not feel guilty about the criminal work the prosecution is charging him with.

During the publication of the final word, accused Bajrovic said that “it's true I was a cop, but all my life I was a cop I had trouble with my superiors, because I've always tried to help people”

The same one added that when the murders occurred, the accused had tried to help, stressing that he had saved Ahmet Elshan on a critical day, and many others.

On the other hand, the accused said he had saved many members of the Kabashi family. The defendant said that he recognized them for building the roof of his house before the war.

According to the Special Prosecutor's Act of the Republic of Kosovo, founded on 15 September 2023, Ekrem Bajrovic is being charged during 1998-1999, committed war crimes against the civilian population, in the municipality of Istog and surrounding villages.

Bajrovic is accused of being a member of Serbian police and military forces, individually and in co-ordination with other people, having participated and contributed to the application of distress measures of murder, raiding, beating, torture, torture, cruel and inhuman treatment, being held in slavery conditions, deportation and deportation of the civilian population, robbery, destruction and destruction of the civilian population of Albanian national population.
