Life imprisonment rarely executables in Kosovo

The Foundation Court in Ferizaj, it is the last to issue the highest sentence envisioning the Criminal Code in Kosovo.

She sentenced Dardan Krivaca to life imprisonment for the 18-year-old Marigona Osmani murder.

Such punishments over the years were pronounced several times by courts, but their execution is turning out to be difficult.

So far, the Supreme Court has confirmed only the life sentence against Gani Krezi, who was convicted of killing and then burning his brother's body in Rahovec in 2020.

Lawyer Ahmet Tahiri says neither the conviction pronounced Monday against Krivaca will become powerful.

The trial in the concrete case has come under pressure, and the first time it's made the same decision, it's normal that it doesn't fall behind, but I don't think it's going to stand on the other steps. It was the lack of professionalism in some judges that made them subject to public pressure, and to receive capital penalties; and for that, these sentences have fallen. Mostly the problem lies with judges in the first degree”, Tahiri said, RTV Dukagjini reported.

While other lawyer Ardian Bajraktari says basic courts must develop fair and unintelligent processes so that the highest-level courts cannot afford to lower such sentences.

So far we have 9 or 10 cases when it was pronounced by the Founding Court, but in most of their cases, whether the Court of Appeals or the Supreme Court has revised these sentences, it is decomposing of the need and necessity that fundamental courts do not succumb to public opinion pressures, but engage to have good management of the process and not to associate with violation<1>, Bajrak said.

Twice with life in prison by the Constitutional Court, Naser Pajazitaj was sentenced to murder Donjeta Pajasitaj, but the Supreme Court completely cleared him of the charges.

The Founding Courts had pronounced their sentence of life in prison, even in the case of Armanda Ali, Valbona Mark, Sabe Mavrovqan, and in the case of the murder of Jtmir Ali.

In all such cases, however, sentences were reduced or marred by higher courts. /Dukagini/
