Had it not been for a decision by Justice Minister Albulen Hadziu to approve a request from the Kosovo Correcting Service ( The SKK) for the admission of convicts to the Smrekonica prison, Faton Hajrizi would not be transferred there in May.
Faton Hajrizi, an escape massacre and sentenced to 25 years in prison, seven remaining escaped from the Smrekonica prison on 5 July.
His escape was facilitated through the change of internal regulations of the Kosovo Correcting Service and a decision signed by Minister Albulen Haxhiu.
Just in the first week of May, a few days before Faton Hajriz was transferred from Dubrava prison to the Smrekonica prison, which is a semi-opened ward prison, the Kosovo Correcting Service would change the Mirtman Penitentiary.
The change of regulation was to ease the criteria for placing convicts in half-open and open prison types.
Based on articles 18, 20 and 22 of articles, there was almost no care at all about the risk of being convicted of community and general security.

Paparac has secured this changing regulation. By its change, the criterion of the remaining years of suffering has been abolished. The standard of disciplinary measures that prisoners had in the past has also been removed. With earlier regulations in effect, prisoners could not be transferred to semi-open or open type prisons if they had disciplinary measures during the period of punishment.

With this reduction of criteria, the SKK has enabled every prisoner with sentences of up to 10 years to be in open type of prison, to get out whenever he is in prison and to risk everyone's life at any time.
The half-opener and open guy means prison/parilage without barriers, no bars in the window, no physical obstacles, and an opportunity to work outside the institution from 7am to 17pm.
With the pre-conventional Tretman arrangement, which was empowered in 2019, it was designed to move to semi-open type prisons with more than four years of remaining sentences.

Also, with such regulations, it was provided that the prisoners had no disciplinary violations at all during the suffering of the sentence. This regulation was adopted during the period of Abelard Tahiri leadership in the MD.

As Albulen Hadziu arrived, at the end of 2022, the arrangement for Tretmania was first approved that allowed for the deployment of persons sentenced to the Smreconica Prison up to ten years of imprisonment, to remove the criteria completely two years later - in May 2024.
For the adoption of this regulation, PKK director Sami Gashi had demanded approval from Minister Haxhiu.

She had approved the change of regulation that would allow prisoners up to 10 years of imprisonment to be transferred to semi-open type prisons by signing a decision on December 28, 2022.

Earlier, between 2013 and 2018, in prisons with semiopened and open wards, it had been allowed to accommodate people for up to two years. These measures were in effect during Hajredin Kuci's period as justice minister.

Then, in 2018 to 2019, with the decision of Kuci's successor, Abelard Tahiri, had been allowed to appoint long sentences for up to three years.
