Initially, the foundation for the detention assignment had revoted the bail measure of 50 thousand euros after missing at the July 1st session, even though it had been reported on the consequences of non-respecting the bail, reports “Justice Vow bet“.

In the Foundation's decision to appoint the detention measure and revocation of bail to Osmani, it was also stressed that another warrant is active against him, thus proving to the police that the same is on the run and could not submit the hearing invitation.
Meanwhile, Appeals on 15 July 2024 has turned him into a re-establishment after Osman's defender complaint, lawyer Besnik Berisha, on the grounds that the Foundation on the case of detention has not taken on the basis of the accused's medical reports, offered by lawyer Berisha.
Appeals' decision has been made by the College of Judges with Mayor Kadrije Goga-Lubishani and judges members Gevdet Abazi and Hashim Colak.
Regarding this decision, the first “Justice Vow” has sent questions to the Constitutional Court in Pristina to see if this court had medical reports on the subject. However, the Court's answer is denied.
The first degree trial before holding the 01.07.2024 court hearing has not accepted any medical reports from the accused or his defence concerning the accused Ismet Osmani”, the Court's response reported.
In addition, the Court explains that they have never accepted any medical reports for Osman at the trial hearing.
Moreover, the defense of the accused has not presented any medical reports ( material evidence) at the court review session or that he will bring a medical report that would prove that the accused is in medical treatment and that he is unable to attend the trial session”, the court's response is further stated.
And all in the end, the Foundation explains that Berisha's lawyer, with the preamble of a complaint against the decision to appoint the detention measure, has been linked to medical reports.
The defense on the case of applying a complaint against the PKR Act.inr.707/2021, on the date 01.07.2024 at the Foundation Court in Pristina, has filed a complaint with several medical reports”, the Foundation's response reported.
Regarding these answers, the “Justice Vow” has also sent questions to the Court of Appeals to know on which basis it has ascertained that the Foundation has not directly and in detail the medical reports provided by lawyer Berisha. However, until the publication of this article, the second scale has not been answered.
The Act against Ismet Osmani, known as “Curri”, Sami Nica, Ilir Boykaut, Mentor Maqani and Adil Thaqi, was founded on November 19, 2021.
The five accused, at the session held on July 15, 2022, were declared innocent of criminal acts that weigh them down.
On November 23rd, 2022, the Constitutional Court in Pristina had ruled out requirements for dropping the indictment and rejecting evidence submitted by defenders, Kosovo lawyers Kelmendi, Besnik Berisha, Naser Soopjani and Artan Kerkeyni.
The Court of Appeals, on the other hand, had confirmed the establishment of the foundation by which the requirements for impeachment and opposition to evidence had been refused.
By contrast, Osmani is being charged by the Constitutional Prosecutor in Pristina for the criminal act of impeachment and obligation alongside Sami Nika, Ilir Boyka, Mentor Maqan. And Adil Thaci is charged with criminal work “Fraud”.
