Andy Pajazit is declared innocent of last year's murder at “Bon Vivant”

The plea about guilt, the accused Pajaziti, made at the initial hearing Thursday at the Constitutional Court in Pristina, following reading the indictment by prosecutor Menduhi Kastrati, reports “Best for Justice“.
Afterwards, Pajazit's defender, lawyer Fanol Krasniqi, said the plea for the second act by his defence was done in consultation with them, knowing the consequences as well. So she proposed her approval to the Court.
Prosecutor Kastrati did not object to the Pajaziti's admission of guilt for the arms-free work, as he said it was made in full compliance with the conditions that are determined according to the provision of the Criminal Procedure Code.
On the other hand, the representative of the damaged party, Hilmi Shala, said he disagrees with the legal qualifications, respectively, with the criminal work charged with.
The damaged “Pala considers that, in view of the late man's actions, the prosecution's actions had to be described as “grave murder”, Shala said, rejecting Pajaziti's admission of guilt for the fact that the fundamental issue is murder.
Even the injured Visar Ramadani said he supports his representative.
Afterwards, Judge Erol Gashi said conditions for admitting guilt have been met, so he approved the pleas made by accused Pajaziti for illegal possession, on the grounds that it was done with full will, given the consequences and benefits of admitting guilt.
However, since for the first work “the murder committed in a state of severe mental shock” the accused was acquitted, Judge Gashi took the decision that they are eligible until August 18th to apply for a conflict of evidence and drop the indictment.
On the other hand, for illegal possession, said the declaration would take place after the criminal case is concluded.
Prosecutor Kastrati said he remains close to the proposal that the detention measure be continued against the accused, as he considers the conditions for which this measure is set and that measures aimed at successful development of criminal procedure must be continued.
Even the damaged side's representative supported the prosecutor's proposal for continuing the detention measure against Pajazit.
“The death of K, it didn't want Andy” either, said lawyer Krasniqi, demanding that his defenders cease the detention measure.
According to lawyer Krasniqi, the wounds of the accused have been life threatening and that wound will remain for life.
And that wound is and will remain for the rest of your life, and the same for that wound will be operated dozens of times. The risk of running away for Andy is not because even Andy is interested in taking part in the trial”, Krasniqi said.
The defendant's defender proposed to the court that the Pajazit detention measure be interrupted and to be replaced with a reasonable measure.
Later, Judge Gashi took the decision, with which he rejected the proposal to cut off the detention measure against Pajazit, while adding that the decision of July 2nd 2024, with which his detention was continued.
