The Democratic Party of Kosovo (PDK) and the Democratic League of Kosovo (LDK) have warned that they will send the Law for Public Officials back to the Constitutional Court, as they consider recommendations that have been made to meet the change of this bill.
These warnings were made on the Commission for Public Administration, Local Powers, Media and Regional Development, where permanent Commission reports concerning the Bill for Change and Fulfilling the Law for Public Officials, which despite opposition controversy, were voted by six majority votes.
MP The PDK, Isak Shabani, has said this bill is politicised and, in this case, has raised the issue of the proposal for this bill in terms of long-term management positions.
This law is more politicised than the previous law. In the transitional provisions in paragraph 3, civil servants appointed to lower-class and leadership positions before the introduction of the basic law are considered to begin the first mandate to enter into force. I want to confirm from you whether it is true that this warrants the first term, as even those who are civilian servants who are indefinitely now are bound to be in these positions at a certain time of”, he said.
Commission Chairman Valon Ramadani has said this proposal has been the very good option proposed by the Government and that there will be a possibility that there will be no violation of the rights of all those who today entered director into a department in the civil service.
This proposal is that no competitions for management positions are announced today, but with automatism the moment this law went into effect they have four years of mandate. The second term for four more years can be taken in performance by their superiors, while the third is declared the workplace by not stopping him from applying. I think it's a very good option that has been proposed by the Government and it will be possible not to become a violation of the rights of all those who entered the director today in a department and who is there today to be in civilian service he continues as director. I think there's no one for over 8-12 years what he gives the most”, he said, Online Economics reports.
MP Shaban cited the Constitutional Court's judgments that have been handed down on this bill, adding that if this law is passed in that form it will be sent back to the Constitutional Court.
“The SIGMA opinion stresses that the deadline is not common in the administrations of EU member states, and in an artificial way they are not presented at the low and medium-sized management level. This reform could easily lead to politicising public administration to the level of entity leaders at the low level of leadership. We'll counter it again and send it to the Constitutional Court. I think that if this law is adopted it goes directly to the Constitutional Court”, he said.
Commission Chairman Ramadani has said there has been neither a comment from the EU nor SIGM on this article.
LDK MP Agim Veliu has said that in this bill the issue of duty indictees remains problematic, the failure to comply with the start of the mandate, as well as many other cases that, according to him, this bill will end with all these problems at the Constitutional Court.
We know today that you have the majority, but we're here to tell you that if this law is adopted in this form it harms the public official and is contrary to certain principles that are known to public officials. There are some provisions that politicise and will be problematic, as is the assessment there. In my opinion, the question of taskkeepers even remained problematic for the risk that the law would end in the Constitutional Court. Because the beginning of the mandate is not being respected as prescribed by law in the cases of leaders of different levels if they are without a mandate, the law gives you the right to take effect as soon as this law has entered into force they begin the regular mandate. Problem issues remain for this law to be completed at the Constitutional Court”, he has said.
VV deputy Besim Muzaqi has said that the position has been used to threats that the bills send to the Constitution.
The threat that it will go to the Constitutional Court is not new to us, but it tells of the goals this opposition has in relation to moving ahead with laws and progress, even in the legislative aspect of which we are called as MP and legislative to send before”, he said.
And MP The PDK, Mergim Lushtaku, has said this bill must be sent to the Constitution. Lushtaku has also quoted Prime Minister Albin Kurti's words to former Prime Minister Isa Mustafa, who declared who violates the Law and Constitution “is super criminal”.
We know very well that according to their leader's notion, Albin Kurti, the one who violates the law and the Constitution is a criminal leader. We know that the super criminals rule in Kurti government. We also have a legal act and the Constitution to prove whether the laws are in accordance with the Constitution. We have to send because there is no compliance that you do this bill in accordance with the Constitutional Court's conviction of the law for public officials. Of the body's legal security”, he said.
Finally, the Commission with six votes to vote on the report, with amendments to the draft law on public officials, which will be prosecuted for second review at the Parliament's plenary session.
