The Centre for Strategic Judicial Cases (CLS) announced that the Constitutional Court in Pristina has adopted the indictment it filed with the non-governmental organisation “citizens active” and has cancelled the Pristina Community's decision to project “Park of Avenue”.
“Aventure Park” was meant to be built in the protected Germ park, but with the final decision, the Foundation has cancelled the decision on environmental permission to implement the project.
Similarly, in 2021 the Supreme Court of Kosovo had decided to postpone the execution of the Pristina Community's decision regarding the project until a final decision on the case.
“The CLS values the Supreme Court's decision on suspending the environmental permit of the Aventurava project and the final decision by the Constitutional Court to annul the decision to implement this project. Such decisions confirm the legality followed by public bodies, denial of citizens' constitutional right to participate in environmental decision making, and the risk of degradation of nature from projects such as the Aventures' Arch”, GLS said through a media report.
The foundation found that the Pristina municipality has wrongly applied the legal basis for issuing environmental permission for this project, respectively, has been called to an administrative guide for providing municipal environmental permits. But such projects, such as “Aventure Park”, according to the CLS, are regulated with the Law for Environmental Influence Rating.
The trial has assessed the arguments that Pristina's Community during the assessment and approval of the UN Avenue Project has violated the constitutional guarantees of citizens by denying the right to participation in decisions concerning the living environment where they live”, the report said.
The “Aventure Park” was meant to include an area of about 70 gold and extend from Bbutci to the Germi park. When it was presented as a project, the Pristina municipality had said that the park would be built using special methods that would avoid logging damage in Germi. / REL
