The American Economic Oda in Kosovo expresses deep concern over the recent verbal attacks by government leaders on independent judicial institutions, particularly the Constitutional Court of the Republic of Kosovo.
In democratic societies, power sharing is essential, said by OEK, broadcasts the clankosova.tv.
Therefore, independent institutions must act without interference in order to preserve the integrity of the democratic process.
Statements affecting these institutions are unacceptable, since they violate the principle of separation of powers and erode democratic values, for which Kosovo has worked hard.
It is the task of all interest parties and political officials to respect the constitutional and legal framework of the state. This includes not only performing functions and fulfilling their responsibilities but also preserving the independence of other institutions. Formation of policies, consensus building, drafting legislation and reviewing legal acts must take place within the borders of respecting judicial independence.
The American Oda echoes calls from diplomatic missions and international organisations in the past for respect of judicial decisions. Such respect is critical of Kosovo's democratic future.
The executive and all political Heeders must recognise and respect the independence of all pillars of power, including judiciary, media, civil society, the private sector and independent regulatory organs. Maintaining these principles ensures accountability and transparency, which are vital to building public trust, increasing citizens' participation, improving governance, protecting rights and freedoms, and preventing abuse of power.
Therefore, the American Economic Oda in Kosovo urges state leaders to respect judicial decisions and refrain from statements that interfere with the work of the judiciary. Kosovo institutions have continued obligation to respect rule of law under all circumstances, thus avoiding arbitrary exercise of power”.
