It says that the judge of the preliminary procedure following the assessment of the State Prosecutor's request and following the assessment of material paperwork and evidence has found the State Prosecutor's request for continued detention is based.
According to the Court, there is doubt that the defendant has committed the criminal act he is suspected of, which stems from material evidence obtained until this stage.
Because there is a suspicion that the same one has carried out the criminal work they are suspected of, there are also legal reasons for continuing the detention, because investigations into this criminal case are ongoing, in the further course, further evidence of whiteing this criminal case will be collected, so there is danger that with the same defendant being released with the aim of avoiding criminal responsibility, the same may be unadvisable to the bodies of prosecution”, further reported in response.
In addition, the court reportedly comes to the conclusion that the defendants ' actions represent high social risk, as he was aware of the age of the injured, criminal acts as such are serious and the consequences that will have on the minor are all inconsistent and argue the continuation of the detention measure against the defendants.
The trial of the preliminary procedure has praised other alternative measures for ensuring the presence of defendants and the management of criminal procedure at this stage, but it has come to the conclusion that in concrete cases the same are insufficient for regular development of criminal procedure. So in view of the facts and circumstances mentioned above, the manner and circumstances of committing criminal acts, the weight of criminal acts, and the defendants ' personal characteristics, in the opinion of the court, continuing the length of two (2) months, for now is essential and reasonable”, it is said in response.
According to the file provided by the “Justice Vow”, it turns out Pulaj is suspected of exploiting the minor in two ways. Initially, he is suspected of giving minors cocaine-type drugs for daily consumption. But in exchange for cocaine, Pulaj is allegedly seeking sexual favor from the minor.
For the first suspicion of rape, the Constitutional Prosecutor in Prizren has made a decision to start investigations on December 21st 2023.
Until Shkodran Pulaj, who holds a bar in Prizren, is being investigated for rape, he has already filed charges of narcotics trading. Even in this process, the minor is involved.
In the indictment filed by the Constitutional Prosecutor in Prizren on January 25th, 2024, Pulaj is accused of having “acted to harm and using the sensitive victim”. All of this is suspected from the summer of 2022 to the first six months of 2023.
At the session of the separate investigation held on 5 October 2023, following Pulaj's arrest by the Kosovo Police Anti-droga Unit, the minor has testified, claiming the drug consumption donated by Pulaj.
To the Pulaj too has been filed on March 5th by the Constitutional Prosecutor in Gjilan for bribery following research conducted by “Justice betrothal” on December 2, 2023, that Pulaj was mediating the case prosecutor, Metush Biray, for failing the indictment for 130kg of marijuana.
