Over 10 years in prison and 56 thousand euros in fine against seven accused of smuggling and banned trade

The Constitutional Court in Pristina has declared a punishment trial against Izedin Mejzin, Vesat Imer, Nexhip Gashi, Naim Abrashi, Besim Sylejmani, Sylla Sylejmani and Armen Ilijaz, condemning them to a total of 10 years and 8 months in prison and 56 thousand euros in fines, who were accused of smuggling and trading banned. The announcement of this act on this case was made on Friday by the chairman of the Judge Lutfi Shala's court, reports “The Justice Act”.

Under the trial, the accused Mejzin was sentenced to 1 year and 8 months in prison and to 15 thousand euros in fines for criminal work “Import, export, supply, transport, production, exchange, mediation or unauthorised weapons sale”.

For the same work, accused Gashi was sentenced to 2 years and 6 May in prison and 20 thousand euros in fines.

Even the accused Abrashi of performing this work was sentenced to 1 years in prison and a thousand euros in fines.

Also for the same deed, he was sentenced to 2 years and 6 months and 20 thousand euros in fines accused Imer.

While accused Besim Sylejmani was sentenced to 1 year in prison for the banned criminal act “Trade “

In addition, accused Sylele Sylejman was sentenced to 1 year in prison.

For the criminal work “Trade, banned“, the accused, Ilyazi, was sentenced to 1 year in prison.

All the accused will be counted as last time in custody.

Under the trial, a total of 99 weapons of the “type will be confiscated. Glock-Auto“and “Sig Suer,“and 723 bullets of different calibre are confiscated.

While, the car seized <x0.>Opel Corsa“and “AudiA3”, owned by indictees Besim and Syleleman, 12,000 and 300 euros owned by accused Mayzini, and 5 thousand euros owned by the accused Besim Sylejmani, are returned to their owners, as there is no basis for confiscation.

On the other hand, according to the court, after the indomitability of this act and after they have paid the fined sentence, accused Majzini, Abrashi and Besim Sylejman will be returned to the amount of money left in the dozani.

At the March 11th 2024 session, special prosecutor Fikrije Feyzullahu has announced that acting under the guidelines of the Court of Appeals and due to the economy of criminal procedure, will make the change and precision of the indictment under the final word of May 26, 2022.

Also, according to the precise indictment, the prosecutor said that according to changing legal qualifications: Vesat Imeri, Nexhip Gashi, Izedin Mejzini and Naim Abrashi are charged with committing criminal work “Import, export, supply, transport, production, exchange, mediation or sale of unauthorised weapons or explosive materials” by Article 372, par.2 and par.1 related to Article 31 of the Criminal Code. On the other hand, Besim Sylejmani, Sylejmani and Armen Ilazi face charges that in co-ordination they committed the criminal work “The forbidden trade” from Article 305, par.2 concerning Article 31 of the Penal Code.

By contrast, on May 27th 2022, the Special Prosecutor of the Republic of Kosovo (PSRK) had requalified criminal activity from organised crime in carrying out criminal acts smuggled with weapons and banned trade in co-ordination.

Otherwise, the Constitutional Court in Pristina, on June 8, 2022, had received a conviction case against seven accused of smuggling weapons and forbidden trade Izedin Mjezini, Veat Imeri, Nexhip Gashi, Besim Sylejmani, Syla Sulejmani, Naim Abashi and Armen Ilyazi, condemning them to 20 years in prison and 42 thousand euros in fines (with each one).

The Court of Appeals, on May 5, 2023, had turned the criminal case against seven indictees into retrial.

According to the precision of the March 28th 2024 indictment, Vesat Imer, Nexhip Gashi, Izedin Mayzini and Naim Abrashi, on March 21, 2019, in co-operation have supplied and transported weapons of the type “Glock Austria” and “Sig Suer”, intended to sell without authorization, according to preliminary agreement defendant Vesat Imer previously provided 25 cases of weapons and placed them at his joint in Fushe-Kosovo and then on his request these packages to the company's driver “Legal Sim” Milot Kukaj, with the insistence of Izedin Mayzin, owner of the company “The Logistic Sim” and in collaboration with Abrasin, Kukaj had taken these packages from the Fush-Kosovo warehouse and sent them to the post object “Logisticism” in Mazgit.

The exact instance says that later, defendants Mejzin, Imer, Gashi and Abrashi as they co-ordinated themselves, repacking and inserting weapons into one of the company's offices “Sim Logistic” with the aim of distributing them, where a total 99 weapons of “have been found and seized during the storage check. Glock Austria” and “Sig Suer” and 723 bullets of different calibre.

With this, co-ordination is charged with committing criminal work “Import, export, supply, transport, production, exchange, mediation or the unauthorized sale of weapons or explosive matter from Article 372, par.2 and par.1 related to Article 31 of the Criminal Code.

Always according to the specific indictment, defendants Besim Sylejmani, Sylla Sylejmani and Armend Ilyazi, from the unknown period until March 21st 2019, to interaction and contrary to the Law on Health, the Law on Products and Medical Equipment and Administration Guides, have bought and sold medical products and drugs with variousrapeutic actions, without banners, with the banners of Serbia, as well as with the expired, which goods are restricted by law.

The precise indictment reportedly states that defendants Besim and Sylejmani have provided the findings by accused Armen Iljazi and from a Serb in northern Mitrovica. It says the defendant Besim on March 21st 2019 receives several packages of medication at the Sim Logistics mail depot with his car and then meets with defendant Syla in Pristina. A package of drugs with the intention of selling at various drugs in Pristina and other countries is said to hand them over and put them in his car, where they are divided.

However, the precise indictment says that the same were being observed by the police and stopped, where other packages of medicine, worth 23 thousand and 785 euros of 30 cents, have been found and seized during search of the defendant's apartment.

By this, they are charged that, in co-ordination, they've committed criminal work “The banned” by Article 305, par.2 concerning Article 31 of the Criminal Code. The rest of the indictment, however, remains unchanged.

Otherwise, in this case, F.H. has been charged, but to him the procedure has ceased because the same one has passed away.

According to the initial indictment, established by the Special Prosecutor of the Republic of Kosovo (PSRK), Izedin Mejzini, Vesat Imer, Nexhip Gashi, Besim Sylejmani, Syle Sulejmani, F.H. And Naim Abrashi, said that from the unknown period of time in continuation to March 21, 2019, acting as an organised criminal group, led by defendants Vesat Imer and Izedin Mejzini, with the aim of performing criminal acts “Import, export, transport, production, production, exchange, mediation or sale of unauthorized weapons” and “banned by various criminal group roles, transported and sold unauthorized weapons and sold goods, which were not meant to have been obtained by illegal authorisation of anti-law.

According to the PSRK, the defendant Vesat Imeri has initially provided 25 packets of Glock-like weapons to Austria and Sig Suer, from a person now unknown with the nickname “Doni”, which he has placed in one of his local offices in Fushe-Kosovo, as well as a few packets of medicaments of different kinds, with the content of narcotics (metamormornnare) such as Tamol XX, which he provided to the defendants, Gashi Gry and Sylman.

The prosecution claims that in a few days, defendant Vesat Imer, under the agreement he calls the defendant F.H., a worker at his joint in Fushe-Kosovo and tells him that these packages to give him to the person who would go to get, where the postman “Sim Logistic”, Milot Kukaj, whose owner is defendant Izedin Mayzini, had received these packages and sent them to the object of “Sim Logistic”, in the village of Mazzit, followed by defendants Izedin Mayzini, Vesat Imer and Nexhip Gashi, had divided weapons and medications into packages aimed at sending to various locations.

According to this indictment, Besim Sylejmani first goes to the warehouse of “Sim Logistic”, with his car, where from defendant Naim Abrashi, the company manager takes a few packages and meets with defendant Sylla Sylejmani, in the neighborhood “Upiana”, who is given a package of medicine and puts it in his car “Opel Corsaque5>, where they're separated, but being under surveillance from the Kosovo Police, the defendants and Syllejmani, in their cars, and they're confiscated with packages, and then they're found in the apartment garage of the”

According to the prosecution, while checking in the “depot Sim Logistic” in Mazgit, total 99 weapons of “Glock-Austria”, an amount of ammunition that is unknown, as well as an amount of medicine, which includes the confiscated amount of indictee Besim and Syla Sylejmani, is about 17 thousand euros.

According to the charge, as well as defendant Amend Ilazi, defendants Besim Sylejmani and Nejip Gashi have been supplied with uncontained drugs, in order to sell to various drugs, in the manner that suspect Armen Ilazi, drugs provided by Indies Mehmeti, pharmacists at the drugtore “Pharm<1> in Ferizaj, and then distributed them to defendants and Nexhip, with this case as participants have aimed at carrying out criminal acts for the use of criminal acts for the benefit of law in a way of law.

The PSRK claims that defendant Vesat Imer during the month of March 2019 has unregulated 25 packages of weapons and medicines and placed them at his bar in Fushe-Kosovo, and then on his request, these packages are handed to the company's driver “Sim Logistic”, Milot Kukaj, whose owner is defendant Izedin Mayzini.

All in all, on March 10 and 15, 2019, defendants Izedin Mejzini, Vesat Imer, Nexhip Gashi and Naim Abrashi, after co-ordinating themselves, repackage the package mentioned by putting weapons and medicines in one of the company's offices “Sim Logistic”, owned by Isedin Mayzin, and in which defendant Naim Abram works with the intention of distributing them.

According to this indictment, on March 21, 2019, defendant Besim Sylejmani receives a few packets of Tambil XX drugs at the “warehouse. Sim Logistic”, and then meets with defendant Syla Sylejmani, who is given a package of drugs for the purpose of selling them to various drugs in Pristina, Ferizaj and other countries, but since the same were being monitored by police, and during the search of their homes and vehicles, significant amounts of drugs mentioned for the sale of which they had no authorization have been found.
