Last year's murder in Dragodan, the witness says that when the accused and the deceased were outside, they heard a crack.

Witness Mehdi Osmani, when giving his testimony in the case of the Dragodan assassination, said that after having stepped out of accused Avni and Mustaf Mustafa and now the late R.T., he had heard the crack.

In this case, Avni Mustafa is accused of killing R.T. in Dragodan and of illegal weapons holding, while Mustaf Mustafa is accused of participating in beating and gunning without permission, while Leutrim Mustafa is accused of evidence manipulation, reports the “Justice bet“.

He later said that when he was out, the ambulance had come and then he asked the doctor about the condition of the late R.T, then the doctor told him that he had changed his life.

The same man said he was sorry that the deceased R.T was not among them and that he had good family reports, adding that accused Avni and Mustaf did not know them, but that their father had known them.

The Witness Osmani said he was sitting at the table with Xhedin Osmani, the late R.T. and the accused Mustaf, and then accused Avni, and that the same had talked to each other about two residences where the witness said he didn't know the issue after not interested him.

Among other things, he added, the late R.T with the accused Mustafa had friendships with each other and that he had told them to agree quietly after you met him, but then according to him the late man said that we could not agree and had been set up by the table.

He said that now the late R.T. and accused Avni and Mustaf were tense and therefore had come to the dispute.

And witness Osman said he was trying to stop the deceased R.T. now. but couldn't because he was stronger and the other person he was with didn't help him stop because if he had helped them, they would have stopped him.

The same also added that in advance the late R.T. had asked accused Avni and Mustaf two residences after he had bought them from them.

On the other hand, witness Osmani said that on the critical day you had seen neither knife nor firearms, adding that the statement given to the police from him was true.

Similarly, at this session was given the opening word by prosecutor Fatmire Cacaj, who said the evidence that was part of the subject paperwork was legal and sufficient to prove the well-based suspicion accused Mustafa committed the criminal acts they are accused of.

According to him, after managing the proposed evidence in the indictment, it will prove that the accused committed the criminal acts they were charged with and that the same would be found guilty.

While the party's representative, Ramdan Tahiri, lawyer Ndek Dodaj in his opening address, said they stay close to the rich-juridic demand, which would determine before the completion of this trial, adding that he backed the prosecutor's opening word.

According to the Dodaj lawyer, the next fact will be confirmed that the purpose of the meeting between the late and accused Mustafa had been linked to residences, not convictions, as alleged by the defendant's defence.

Among other things, the same said that in this case, they involved serious murder, not murder, as had been described in the indictment.

On the other hand, defendant Avni's defender, lawyer Besnik Berisha, said that this criminal case would not be difficult to try because there was a film show that on the critical day of the late R.T. had attempted to take the life of accused Avni and Mustaf Mustaf who were brothers.

According to lawyer Berisha, this event occurred because of allegations in which the deceased on behalf of the file had searched for two residences, where after the accused had refused to give the same to him, he was told he would make “share”.

Also seen at this session were the video recordings of the critical moment that attorney Berisha described, which he said was all seen in those videos and that the late R.T had tried to take the life of the accused Avni and Mustaf.

This was the moment, this was the actual immediate attack on Avni Mustafa's life. The knife was the means by which the two brothers Mustafa who were now on the way out of the hotel trying to escape evil”, said lawyer Berisha.

Lawyer Berisha said in the end they expect a criminal conviction for the criminal act of arms maintenance, while a free trial for the criminal act of murder against accused Avni.

On the other hand, the opening word was also presented by the defender of the defendant Mustafe, lawyer Skender Musa, who said he strongly supported attorney Berisha's statement, adding that in terms of his defense the state prosecutor had wrongly implemented the provisions of the Code of Criminal Procedure.

He said that in this trial process it would prove that the legal provisions were violated during drafting the indictment, adding that accused Mustafa in this case has removed the attacker from killing his accused brother Avni.

Today's session was interrupted after the end of the regular schedule and the next session is expected to continue on another date.

According to the indictment filed on October 11th, 2023 by Pristina Constitutional Prosecutor Avni Mustafa on March 19th, 2023 around 13.20 near the hotel “Adria” in Pristina due to a property dispute allegedly guilty of the deceased R.T.'s life by beating him once with a pistol in the chest region.

Indictee Mustafe Mustafa in the same place is charged with the “share in beating” and “ownership, control or unauthorized possession of weapons”.

Meanwhile, accused Leutrim Mustafa is charged with criminal work “manipulation with evidence” after he reportedly admitted by Mustafe Mustafa's now defendant Avni Mustafa's bag, in which was the “Zasawa” revolution, and you hid the same in his office.
