Democracy Plus estimates that the case of Pristina's collapse of the peak scatters the consequences caused by the lack of sanctioning companies that violate the Public Procure Law.
Ardit Dragusha from Democracy Plus said this analysis aims to reveal specific cases of public procurement fraud, which are not sanctioned by responsible bodies, Kosova Prees reports.
“With January 18th 2024, as a result of strong winds, Pristina's peak fell, causing material damage and human injuries. This event exposed the consequences caused by the lack of sanctioning companies which consistently violate the Public Procuration Law (LPP).
The Pristina municipality in January 2023 allocated 700 thousand euros for the renovation of the new municipality facility. The contract awarded the NBT company- ING U.P.K., which offered 38,000 euros, or about 300 thousand euros less than the anticipated value of the contract. The company, which was declared winner of this tender and carried out works at the peak of the municipality's facility, has a history of public procurement fraud”, he said.
He stressed that the owner of this company on two different occasions has been sentenced to the court's ruling on counterfeiting and fraud in public procurement.
“In the first case NBT Company- ING S.P.K., in 2018, had forged documents in the tender for the construction of the Multi-Verestitic-Strpce Road, worth the anticipated 1m-euro contract initiated by the Suhareka company. The Constitutional Court in Prizren had found the company's owner guilty of counterfeiting documents and pronounced the fine worth 900 euros.
Second case NTB Company- ING Sh.P.K., continued to win public contracts, and in the second case, is in 2020 in the tender énovation of the Special Prosecutor's object, worth about 1m euros. Even for this tender, the owner of the company was sentenced to the court's decision because of misuse and fraud in public procurement, being fined two thousand euros. Despite the court's two cases of condemnation, this company continues to win a public tender and, until the Pristina municipality case, which dropped the” peak, he added.
Furthermore, he stressed that the Suhareka municipality and the Prosecutorial Council had not applied to the public procurement review body for the qualifications of the relevant company.
Exiona Kozhani of Democracy Plus said such sentences are not in proportion to the level of risk.
These differences between court decisions and violations are spreading a failure to comply with decision-making by competent bodies. It is also encouraging economic operators to continue making these decisions.
So in this line of Democracy Plus recommends that whenever false documents are sent, the contracting authorities use blacklists and disqualify economic operators. Also, the court during the decision to take into account the risk caused by the violation and issue sentences proportional to the risk caused”, she said.
