Doyle: Former KLA leaders cannot be tried in freedom, cause of justice and escape

Speaking specifically of former PDK leader Kadri Veseli's request for freedom trial, Doyle has said there is a danger the accused may have “committed other crimes”.

As for extending this judicial process, Doyle has argued that the deadline is until April of next year.

“I would not like to give an assessment of whether the court's process is going slowly, but what we know is that the cases continue now in 13 months and over these 13 months, the Judicial panel is repeating their request towards the parties by asking them to hold conferences, adjust and initiate new laws which, for the purpose, have not only a fair and correct trial but also a trial as soon as possible. The prosecution has earlier given a deadline until April 2025 for presenting their case, and judges have taken steps along with the parties on how to proceed as soon as possible”, Doyle has said of EO.

DPS spokesman is not very optimistic that this process will be completed in 2025, but that have called for speeding up witness interrogation.

 

 

 

“I wouldn't like to speculate about this but what we've heard recently this week in the courtroom, we've heard judges asking whether and how they're planning to end their case over this deadline and we've heard the prosecutor say they're still working towards the deadline set for April 2017, but they've also said they've been looking for reduction and acceleration in walking evidence”, he said.

As for former Prime Minister Kadri Wessel's request to be tried in freedom, Doyle has said the court has seen fit to refuse him because of obstruction of justice. The court's <x0). So far the court has found that there is danger of continuing to prevent and possibly other crimes. There have been indicators, data that certain things have been communicated in the detention chamber for protected witnesses, and thus far judges say the danger the accused could prevent the process and commit other crimes”, he stressed.

Asked whether during this process there is presence of evidence from the Serbian side, Doyle has argued that the Court and Prosecution are divided. He has said it is the prosecution that tries to find evidence and convince the court of such a process.

The way evidence and evidence work is that the prosecution, which is independent of the Court, is neutral. The prosecution investigates and tries to find the suspect, the defence tries to show the prosecution has not presented the evidence properly and the court is in the middle so it judges only if the evidence is authentic relevant to the case, but it is the prosecution that brings the evidence to court”, he said.
