Trial of fraud and corruption, witness says he had not signed the contract

Similarly, witness Ahmeti has denied to have used someone else's seal, except for smaller acts that have not needed verification.
On this issue, he said he had asked the investigator to open a separate procedure to verify whether that contract or precontact has been sealed or the stamp has been scanned.
He said that when he took a look at this contract, which he said had been brought to two Obilic municipality officials, the copy that he believed was similar to the original, as the original always remains to the swimmer, had noted that he is not his act.

According to the indictment compiled on March 31st 2023, the Constitutional Prosecutor in Pristina, they are charged that in the quality of official persons, Neriane Kelani-Sherifi-Sherifi of the property sector in the Obilici municipality, and Arben Berisha-Director of Urban Planning, Property and Cadastre in the Obilic Community, in co-ordination, exploiting office or official authority.
As reported in the indictment, accused Kelan-Sherifi deliberately exceeded their official competencies, so that on the 1803.2022 basis, he compiled and signed the V-315 Act on property delivery, in Milosevo, Obilic Komuna, on the surface of 11,034 m2, for carrying property from the owner J. R, currently defendant Ramadan Hasani, based on “Paracontrate for real estate trading LRP number 1276/2022”, contrary to Law 04/ L-009 articles 4, for establishing real estate rights registry.
Among other in the indictment, it is said that for carrying property must be presented “contratata” on real estate trading, and not “Paraconstrata”, and the same agreement with the number of V-315 has signed the accused Arben Berisha, even though he was notified by the accused Nerian, that the act of carrying property was taken based on paracontras, with this has caused damage to the other person, in this case of the late xR.
With this, accused Kelani-Sherifi and Berisha in co-ordination have committed criminal work “The use of official position or authority” by Article 1414 paragraph 2 related to Article 31 of the Kosovo Criminal Code, which is punishable by fines and imprisonment of three to ten years.
