Teki Boxi: Kosovo cannot sue Serbia for genocide, that could be third state

Lawyer Teki Bocshi has spoken of the possibility that Kosovo would sue Serbia for genocide at the International Court of Justice. According to Bocshi, this is not possible, as Kosovo is still opposed to international subjectivity by some of the important factors.

However, according to Bocsit, there is an opportunity for Serbia to be held accountable at the International Court of Justice for the crimes it has committed in Kosovo, and this can be done through a third state that can file indictments against Serbia to defend Kosovo's interests.

“To prosecute in the tribunal practically requires international subjectivity, eventually there is a possibility that as a subject another state to defend Kosovo's interests, in the current situation there are complications related to the Security Council and the election of judges I think is very difficult other than this solution, which is probably possible through another international subject”, said Bocshi.
