He has claimed that this is clearly seen in Article 2 and 4, remembering that Article 2 requires Serbia to accept sovereignty and territorial integrity in accordance with the UN Charter and to give priority to the principle of self-determination of international law in relation to other principles of sovereignty and territorial integrity.

On the other hand, he stresses that Article 4 requires Serbia to allow Kosovo access to international organisations without exception, including the UN and UN system organisations.

Therefore, it concludes, Serbia has reservations for the Ohrid Agreement and “does not consider it mandatory”.

The inclusion in chapter 35 is an attempt to firmly impose Serbia that the Ohrid Agreement is binding for Serbia and that it is a condition for membership negotiations, namely for EU membership in the future when it happens. This is already quite clear and questions the further negotiation process because it already enters Serbia's <x1-lined red “for which Serbia is not ready and for which it cannot negotiate with Serbia, because we have at least three restrictions on Serbia's Constitution, the mood and general position of majority in the country and finally, international law and Resolution 1244, which says something quite different<3>, has claimed Milivojevic.

He has also claimed that with the introduction of the Ohrid Agreement in chapter 35, “The EU is discrediting itself as a mediator in negotiations for normalisation”, because, in his words, it is making a status statement.

Asked whether with the Ohrid Agreement's entry in chapter 35, countries that do not recognise Kosovo support Kosovo's membership in the UN, Milivojevic stressed that there is a kind of judicial and political balance on the issue.

He stresses that there are no provisions for recognition in the Ohrid Agreement, but that provisions in this document create the conditions for it.
