The prosecution seeks Sekirasha's sentence, the latter says there were no problems earlier with Riza

At the Constitutional Court in Pristina, with the giving of final words has ended the trial of Enver Sekiraqas on Monday, in the case where he is accused of inciting the killing of Triumf Riza. In this hearing, the accused claimed that he had never had problems with the deceased before, while special prosecutor Burim Cherkini said Sekiraqa was the leader of the group that ordered the murder, so he was prosecuted responsible.

Final words were written by special prosecutor Burim Cerkini, injured by Shefqet Riza and defender of accused Sekiraqa, Kosovar Kelmendi, reports “Justice Vow”.

Prosecutor Cerkini, during the elaboration of the final word, said that during the trial management, Sekiraqa has carried out the criminal work he is charged with, adding among other things that the accused was leader of the group that ordered Riza's murder.

“Enver Sekerqa was the leader of the group that had ordered the murder of the late Triumf Riza”, said prosecutor Cerkini.

In the end, prosecutor Cerkini declared that the court should be trusted with evidence presented, adding that there is no circumstance barring the criminal responsibility of accused Sekiraqa and that he has been prosecuted responsible.

The prosecutor proposed to the court that the accused Sekiraqa be found guilty and that on the case of measuring the sentence considered a serious circumstance in the accused's criminal past.

However, the injured Riza was unable to clear her final word because of her load.

The injured man added that he stands behind whatever rights are granted by law and that he agrees with the final word given by prosecutor Cerkini.

On the other hand, lawyer Kelmendi sought justice by the court, demanding a free trial in this case and rejecting the indictment.

According to Kelmendi, there is no evidence the accused Sekiraqa has prompted the killing of the late Riza now.

There is no single evidence that Enver Sekiraqa has sparked the murder of the late Triumf Riza”, said lawyer Kelmendi.

Among other things, the lawyer said the convict for the murder of Triumf Riza, Arben Berisha, was not part of her defence group, and that he had stated in the case that Sekiraqa had not urged him to carry out the murder.

Lawyer Kelmendi also added that the administered evidence proved there was no motive for accused Sekiraqa to now kill the deceased and that incriminating actions described in the indictment do not form criminal work.

Presequently, accused Sekiraqa said he stands near statements previously given in this judicial and more specifically in statements he had made in 2015, before EULEX's court.

Sekiraqa said he was willing to answer the questions of the prosecutor and the court if they have questions.

But, prosecutor Cerkini said there were no questions about accused Sekiraqa, while in court questions, the accused said he had never had problems with Riz pre-x0> Swiss Cassinos”.

Among other things, Sekiraqa said she could not deny that the late Riza had now escaped from bullets in the case of “Swiss Cassinos”, adding that Arben Selmanaj had a gun to his head.

Sekiraqa declared that he had not told the witness John Kqira that he had now beaten the late Triumf Riza when he had gone to visit him.

According to him, the witness Kqira had sent Arben Selmanaj to him to reconcile himself, adding that he had told him that he had no business with them and that he left justice.

The defendant also said that at the moment you have no business with anyone, you have forgiven him and that the matter is closed. On the contrary, he points out he'd say he'd pay back and he wouldn't trust him, and this Sekiraqa says he didn't say.

Otherwise, the start of the Cerkini prosecutor's hearing said it stands behind the September 29th 2023 proposal for the management of material evidence, while lawyer Kelmendi said she remains close to objections made to these material evidence.

In the end, this criminal case was declared completed, and the next session is expected to issue a plea.

The Constitutional Court in Pristina, for the second time on September 16th, 2019, had convicted Enver Seker Sequirah of inciting the murder of former police officer Triumf Riza and had pronounced him a 30-year term sentence.

However, the Court of Appeals on March 6, 2020, had decided to approve Sequirah's defense complaint by turning the case for the second time into retrial, as according to Apelit, the first degree of judgment was taken in violation of criminal procedure provisions.

The session for the same case was condemned on May 17, 2016, for two counts of criminal action for “in inciting serious murder” and for the “dyrim” with a unique sentence of 37 years in prison, and had been released for criminal work “rape”.

The Court of Appeals, on October 24th 2017, had held a hearing concerning the appointment of security measures to Enver Seker Sequirah, after the same court on October 19th, in the evening hours, had freed him from custody and pronounced him the measure of house arrest.

For changing the security measure against him, three Appeal judges -- two of EULEX's ranks -- Elka Ermenkova and Anna Adamska-Gallant, as well as local judge Marem Memaj.

But this court, after just two days, had decided to return Enver Sekiraq into custody again, and for that, a photograph had been published on the social network, from friends who had visited him after his release from custody.

With this, the second-instance court had estimated that Enver Sekiraqa violated the measure of house arrest he had been assigned.

In contrast, at the hearing of the Court of Appeals, which was held on September 6, 2017, where complaints of the parties were considered, Enver Sekiraqa, had sought to be released from custody and protected in freedom.

And as a guarantee of his release, Sekiraqa had offered his wealth, including his home, establishment, and a sum of money, which he had said would be collected with the help of his family.

The international prosecutor of the Appeals Prosecutor, Anca Stan, at the September 6th session of the Appeals College, had stated that besides the complaint claims, there was nothing to add, but the same had said that the demand of the defence party to exclude some of the crude evidence is wrong.

In April 2014, the Special Prosecutor of the Republic of Kosovo had filed charges against Enver Seker Sequirah for three criminal acts, for inciting the murder of Triumf Riza, <x0detyrim” and “rape”, where the first-degree court had declared him innocent.

The prosecution claims the incident occurred in “Swiss Casino” between Sequirah and Riza was one of the motives that led to the killing of Triumf Riza.

In “incident Swiss Casino” had occurred in December 2006, while Enver Sekiraqa and several of his escorts were included on one side, and the late Triumf Riza of Arben Selmani on the other. Arben Selmani was left in this seriously injured incident.

Triumf Riza was killed on 30 August 2007, for which Arben Berisha was sentenced to 35 years in prison, while Enver Sekiraqa was sentenced to 37 years in prison
