Democratic League of Kosovo deputy leader Lutfi Haziri says Prime Minister Albin Kurti will submit the draft state of the Serb majority municipalities to the Constitutional Court as countering membership in the Council of Europe.

According to him, Kurti will do so before the meeting in May of the CoE Foreign Affairs Committee, as he considers that the government leader so far has turned any denial into admission, while considering that his current position is only for domestic consumption. Haziri stresses that sending the draft proposed by the Euro-Americans to Constitutional in exchange for KiE membership is the lowest position Kosovo has been able to realise, as there have been other possibilities as speeding up the road to NATO membership.

Haziri in an interview for Kp says that if Prime Minister Kurti refuses to submit the draft to the Constitutional Court, Kosovo will lose access to Council of Europe membership.

“There is the possibility that Kurti will adopt the draft status quo proposed by the EU, called the European proposal, and that as he enters the government, the Kosovo Government document becomes and is taken to the Constitutional Court. Then the Court has its deadline for commenting on whether it is in a constitutional spirit. It enters the 45-day implementation mechanism, as the EU has the task force, the task force for monitoring implementation. Logical that should happen, if Kurt is driving away, then he loses Kosovo the opportunity for membership. Mr. Kurti every denial of him has turned into admission so far. According to him, Kosovo's international partners have lost confidence in Prime Minister Albin Kurti, therefore want tangible actions to establish association, despite the letter of the heads of state to the Council of Europe that after membership in this international mechanism, procedures for the establishment of AKS will be launched.

If Kosovo enters such conditional relations by asking for something as a reward, it turns out that this government will take it to court in exchange for membership in the Council of Europe. This is the lowest position Kosovo has been able to realise. There are other possibilities, accelerating the road to NATO partnership or speeding up the road to European integration”, Haziri adds.

The second of the LDK, he expresses his concern if the Constitutional Court can clear the draft association status of elements that it claims are unconstitutional. According to him, the constitution cannot change the draft-status structure, but what it can do is terminology and harmonisation with the constitutional spirit.

“They cannot change the structure, character of the international agreement. They can harmonise and establish the constitutional spirit. It's constitutional or not said. What you can do with combing is terminology. If it is not in accordance with the constitutional spirit, no more. What we found a serious problem in the document is that it breaks the unitary character of constitutional organization. The aspect of territorial autonomy and other” parts, Haziri points out.

Kosovo's international partners have been frequenting calls for the submission of the Association draft, proposed by the European Union and supported by the US to the Constitutional Court, as a key step for Kosovo's membership in the Council of Europe.
