These guys are down at the weekend to work, even if NATO brings to”, a clash between the lawyer and the prosecutor in the Podujevo murder trial.

The initial hearing against accused Edsim Syla for the V.B. murder case in “Interex” in Podujevo has been postponed Wednesday at the Constitutional Court in Pristina because the defence has not accepted all evidence concerning the case. This sparked debate between prosecutor Duline Hamiti and Syla's lawyer, Besnik Berisha.

Initially, prosecutor Duline Hamiti stated that she has equipped her with subject paperwork to protect the accused side, lawyer Besnik Berisha, but with regard to CDs, said they are multiplying and in the moment of completing their breeding will be handed over to defenders, reports “Best for Justice”.

On the other hand, lawyer Berisha said the defence is partly equipped with subject papers and that he is unaware whether the prosecution has any evidence other than those he has accepted. He said they consider the prosecution not fulfilling the obligation to submit evidence.

After the effort and only after the court's intervention several times, I've been partially equipped with subject paperwork, where in addition to the missing 21 CDs, material evidence is missing, the forensic expertise report of the 2010.23, compiled by forensic expert Flamur Dylhasi, to damage L.S.S., the investigative analysis report along with a random CD number, case-counting process, realising that the number of CD vehicle and the 21-contacts with the same numbers, Berisha said.

According to him, this list of missing evidence has been drawn from the list of evidence proposed in the indictment.

And we're not aware if the Attorney's available any more evidence he hasn't discovered in us by this court. For these reasons, it cannot be considered that the prosecution has filed the obligation to submit evidence”, said lawyer Berisha.

Lawyer Berisha also stated there are no conditions to proceed with this process.

Even the chairman of the court, Fatime Dermaku, stated that it cannot be continued with initial consideration because the defense has not accepted all evidence, with the reason that the rights of guaranteed parties with the Constitutions and the European Convention on Human Rights are violated.

The judge asked prosecutor Duline Hamiti to declare regarding the deadline when it can equip protection with material and CD paperwork.

“Requesting from the state prosecutor to give us a date when the defence attorney with CDs and all paperwork” can definitely be equipped, Judge Drimak said.

And the prosecutor Hamiti was declared that the moment the CDs were multiplied, she will be equipped with CDs.

After the court commissioned the prosecutor to supply the defense with case papers, attorney Berisha said he does not believe the prosecution will fulfil this obligation, since, according to him, Prosecution “and if NATO falls, it does not work”.

Prosecutor Duline Hamiti demanded that Berisha's statement be identified in the process and that she considers the most serious insult she has experienced in the prosecutorial system.

I have the testimony that I've come out on Saturday, and I'm not going out on the weekend, when I've been a babysitter, all week long and I've been out, and I have the evidence that I've come out on Saturday, so badly offended by the prosecutor that's not allowed to task for”, said prosecutor Hamiti.

And lawyer Berisha said the Court through e-mail has clarified the rights and obligations to the prosecution.

“And these not only don't treat the holiday on weekends and during the day, but until yesterday, they don't do anything about it”, Berisha said.

According to him, if the prosecution read the court's e-mail and didn't answer, it's disrespect or contempt of the Court.

On the other hand, the head of the court, Fatime Dermak, said the prosecution was to blame for the situation.

Procurial, as for knowledge of the tank, if there is someone we are in this situation, we are here because of the Constitutional Prosecutor in Pristina, who has not committed the legal obligations prior to Article 239, so that's simple”, Dermaku said.

Otherwise, Arsim Syla is charged with the V.B. murder case on September 11, 2023, at “Interex” in Podujevo. In this case, the victim's wife was injured. The other defendant, however, is on the run.
