The Court of Appeals has turned the criminal case against indictees Lirim Jakupi, Africa Ismajlovic and Faton Osmani, charged with killing B.V with 14 bullets.
In the decision provided “Justice Vow”, reportedly the defenders' complaints have been approved, so the case has returned retrial.
“with approval of alleged defenders' complaints L. J, A.I. and F.O., but even on official duty, the Constitutional Court Act is annulled - The DKR in Gjilan... dated 01.12.23, and the case goes back to the first-instance court, to the retrial and the”, says Apel's decision.
Unlike the Constitutional Court in Gjilan on November 13th, 1923 had sentenced accused Jakupi, Ismajlovic and Osmani to 14 bullets in the “Premium” cafe.
Under the trial, Lirim Jakupi had been sentenced to a unique sentence of 27 years in prison, Ismajlovovic to a unique sentence of 24 years, while Osman was sentenced to 15 years in prison.
Otherwise, according to the Constitutional Prosecutor's Act in Gjilan, set up on September 30th 2022, Lirim Jakupi and Africa Ismajlovovic reportedly on September 12, 2021, about 19:42 minutes, at the “cafe Caffe Bar “Premium” on the “Villiam Shakespeare” in Gjilan, following a preliminary preparation, deliberately and in interactions, have now deprived the dead B.V. of life, from Gjilan and have deliberately endangered the lives of some other people who have been in cafes and close to the deceased now.
The defendant Faton Osmani, on the other hand, is said to have helped defendants Lirim Jakupi and Africa Ismajlovic, in carrying out the now-dead B.V. heavy murder. Details from the full indictment of this case are found: THESE
