Daka: The April 21st vote is illegal and unconstitutional, I hope it will be the last time Kosovo organises something like that

Valdete Daka, judge and former head of the Central Election Commission, has been the next guest in Blic Interview with Astrit Gashi.

Daka, in terms of administrative instruction, through which Albanian mayors of the four municipalities in the country's north are expected to be dismissed, says it is unconstitutional and illegal.

I have repeatedly mentioned that the administrative instruction that has been issued by the ministry is outside the Constitution and illegal, because it gives some competencies to the CEC, which by law, the CEC does not have over general elections. The CEC, under the Constitution, organises elections and referenda -- that is, the referendum which the CEC currently holds on 21 April -- has no law at all, because first it should be a law regulating the organisation of referenda and then the CEC is set in motion. The CEC's direction through a directive that is a sublaw, itself is illegal, because it cannot be given the CEC competencies for something that has no constitution”, Daka said.

It also points out that the April 21st vote is not only illegal, but not constitutional. She hopes it will be the last time Kosovo organises something like that.

“I confirm that this April 21st vote is not only illegal, but also not constitutional, and I hope it will be the last time that Kosovo organises something like this, because if that happens it will really be a dangerous precedent that can be exploited by whatever party, against any mayor in any municipality of Kosovo”, she added.

The former CEC chairman, says that while the CEC does not have the law for referendum, it cannot alone set the date or become a lawmaker.
