The Constitutional Court in Prizren, the Department for Mittur, the judge of the procedure, has set the detention measure, in length of a (1) month, which will be counted from the time of arrest of 21.03.2024 and may last to 20,04.2024 against defendants D.D., (20 years), and P.B., (19 years old), due to suspicion that each committed a criminal act of violence by Article 227 paragraphs 7, (when the criminal act is committed to the person under 14 years of age) concerning par. 1 (Whoever forces the other person to commit sexual acts without the consent of such a person), the Kosovo Criminal Code's KP.
The judge of the preliminary procedure after holding the hearing for the appointment of the security measure and hearing of the parties' statements, and on the basis of evidence on the subject papers, has found that the State Prosecutor's request for the detention assignment is based.
The court, in case of detention, has estimated there are legal reasons for the appointment of this measure, and from evidence collected until this stage, is a suspicion given that the defendants alone have committed the criminal act for which they are suspected.
In the case of the detention appointment, the Court has taken into account the fact that the case is in the initial phase of the investigation, and the defendants and the eventual witnesses will be questioned. So with the release of the defendants to freedom, there is speciality that the same will prevent the course of the investigation procedure.
The court has found that the appointment of the detention measure at this stage is necessary, taking into account the heavy burden of the criminal offence for which defendants are suspected, and the circumstances under which criminal acts have been allegedly committed, so with the release of defendants, there is the risk of fleeing with the intention of avoiding criminal responsibility.
From tops, the Court has concluded that in concrete cases the appointment of detention for defendants is necessary and reasonable.
