Special Prosecution Draws Back From Prosecution Against Organised Criminal Suspects

In this case, the court had taken a free trial against former mayor of the municipality of Gjilan, Kemajl Mustafa and other indictees, reports “The Justice Vow”.
The special prosecutor, Burim Cherkini, at the beginning of the court review, withdrew from prosecution against the Govori accused, arguing that the other 35 indictees have been acquitted of the indictment and that with the conviction of the formal form, that the actions of the accused Govori have been involved with others.
Prosecutor Cerkini said that procedures had been isolated against accused Govori in this criminal case, while procedures have been completed as far as others are concerned.
He said there is an act of the Constitutional Court in Pec, which was followed by the Court of Appeals' bias, with which the indictment has been confirmed and the accused released in absence of evidence.
Because accused Burim Govori has been part of this indictment for the criminal acts he is suspected of and accused of, Burim Govori, have been in co-ordination and as part of the other accused group, where we have an act of formal form. To the accused Burim Govori, we withdraw from prosecution”, prosecutor Cerkini said.
Thus, the judicial examination ended with the declaration of a rejection act.
The Constitutional Court in Pec, on April 13, 2023, declared a free trial against Kemal Mustafa and 34 other indictees, while Appeals confirmed this act.

By contrast, according to the Special Prosecutor's Act of the Republic of Kosovo (PSRK) established on September 16, 2016, in the Gjilan municipality, 18 tenders have been made known for which 39 defendants were initially charged, of which 29 were municipal officials and 10 economic operators.
P The SRK claimed that former mayor of the Gjilan municipality, Kemajl Mustafa and others, have been setting up tenders in order for them to earn certain businesses, so they were tasked with criminal acts of organised crime in connection with the criminal work of abuse of official positions, as well as misuse of authorisations in the economy.
