According to him, its eventual implementation would be transformed into judicial standards -- in the law, respectively -- and, as such, would be a dangerous and irreparable precedent for Kosovo.
“The heads of state must be cautious and determined that the Constitutional Act will not be implemented. They must convince the EC member states before voting on Kosovo's application for admission in this organisation that the eventual implementation of the Constitutional Court will be a dangerous precedent for Kosovo and that Kosovo can slip into Montenegro's fate on property and Orthodox churches”, he said.
Furthermore, he said Kosovo should first declare invalid laws and decisions Serbia has from 98-99.
“Kosovo has previously passed a separate law with which it would declare all laws, decisions and sublaws that Serbia has taken for Kosovo during the 98-99” period, Imeraj added.
