Organisation that brought down Serbian falsehood about expulsion urges Kosovo to implement Decani Monastery decision

The European Initiative for Stability (ESI), an international organisation that days ago published its report, titled “Pogroms invented statistics, lies and confusion in Kosovo”, has published a new report on Kosovo.

This time around, this organisation has called on Kosovo to implement the decision on the land of the Decani Monastery.

To join the Council of Europe, members must make a credible commitment: Every member of the Council of Europe must accept the principles of rule of law and joy from all persons within its jurisdiction of human rights and fundamental freedoms, and co-operate sincerely and effectively in the realisation of the Council's purpose. (Nini 3, Council of Europe statue adopted in 1949). That's what Kosovo is required to do. And why now is the time to finally settle the Decani land issue forever, opening the door to membership in an organisation that will protect human rights in Kosovo in the future”.

So wrote the end of this report, the ESI organisation, whose members have stayed in Kosovo last week.

The memo team published on the ESI official website has made a summary of developments that have led to the monastery's land decision.

The largest part of this land has been registered for a long time in the cadastre as possession of the Decani Monastery. But 24 parcels -- those that include field A and forest B -- as well as four small parcels of land in the middle of the city of Decani (see in the photo below, Saint.red.) - were registered in cadastra on behalf of the monastery in early 1998, after being donated by the Serbian state at the end of 1997”, the report says.

The report further explains that 24 parcels donated to the monastery in 1997 all had the corresponding numbers of parcels.

Explaining also how it came to an agreement between the Decani Monastery and the AKM (ish AKP and UNIMK.

The deal was reached in 2009, and several pledges were made in that agreement.

AKM and UNMIK officials had pledged that they would not seek monastery property, nor would they give someone else the property found in the protected area around the monastery.

In exchange, the AKM had asked the monastery to give up property it had registered in the city of Decani.

Father Sava Yannaq, the Igumen of the Decani Monastery, had responded:

“As representatives of the monastery, we think that this proposal is real, so if all the property that has been contested and which is within the protective zone, if the monastery remains owned, the monastery will have no claims for parcels in the centre of the city... our priority has been and is the land within the protective zone which we consider essential to our economic and other”.

However, the question was over here. That was after the case was sent to various courts to end up in the Constitutional.

Even this one had supported the decision made between the AKM and UNMIK on one side, and the Decani Monastery on the other.

But this decision has not yet been finalised by Kosovo institutions, which government after government is reluctant to sign the 2009 decision.

ESI's report calls for Kosovo to implement this decision, especially in light of the expected response to membership in the Council of Europe.

There is an additional reason for the Kosovo government to operate today, and to resolve something that all previous governments have failed to resolve.
