Smakqi has clarified the entire procedure in detail, calling on the prosecutor of the case to close in the first review, without the need for journalist Lirim Mehmetaj to intensify.
He has said journalist Mehmetaj has won this case, and has quoted Article 40 of the Kosovo Constitution.

There is no chance of passing any state prosecutor's claim on the freedom of expression by journalist/opionist Lirim Mehmetaj for his criminal act to promote division or failure by Article 141 of the KKP.
Article 40 of the Constitution that Kosovo guarantees freedom of expression, the International Convention directly implemented with Article 22 of the Constitution of Kosovo, and the judicial practice of the European Court for Human Rights in Strasbourg have proven in many cases that language used to persons with public and political executive responsibility by each citizen or journalist cannot be restricted either because it constitutes the essence of freedom of expression and media.
So the State Attorney without prejudiced his bias with a preliminary review of the complaint party's claims would have to close the case after having to call the interview.
This practice of prosecution that the state conflicts with Article 40 of the Constitution of Kosovo and that it would be nominal for the chief prosecutor of the Constitutional Prosecutor or Kosovo Chief Prosecutor U.d. to take away the current prosecutor's mind to restore the constitution.
In the EU reports for 2024, this case against Freedom Mehmetaj will be recorded as the tendency to intervene in media independence and violation of freedom of expression.
Freedom needs no defender at all because it is protected by Article 40 of the Kosovo Constitution.
