Toby Cadman, who has been paid for two months, said in an interview for T7 he is willing to do so even without money.
I've been working on the case for two months and I'm not paid. I've never received any funding before. Since my appointment, I applied through the justice ministry. Unfortunately, there has been a major delay on the part of the justice ministry because at one point they have adopted a new regulation where they have fully changed the framework of how the legal teams are paying, and especially what we are referring to. They've cut tariffs and made 1,000 euros a month for our entire legal team, and obviously it's not a serious approach to these things. These are serious charges, Mr. Shala can be sentenced to 10 years in prison, and of course 1000 euros is not a serious approach. Now I certainly have responsibilities to Mr. Shala because I have promised him that I will continue to represent him regardless of the circumstances, but at the moment that puts us in a very difficult position as to how we can represent his interests”, he said.
Changing the regulation for their financing by the justice ministry, it is considering it an illegal process.
The decision that was made and the legal regulation changes was after we were appointed and after applying a requirement in accordance with the law. We say it is an illegal process that the justice ministry has undertaken and thus appealed the decision. The minister dismissed the complaint just days ago and is now considering what further legal measures to take against the ministry and the government. Because what we need to understand is that this is something that radically affects the right judgment of these individuals and of course all three individuals in our case are on trial, all we're looking for is the adequate funding to enable us properly”, he said.
According to him, neither the Ministry of Justice nor the Government of Kosovo are taking this matter seriously.
What we need to remember is that the Special Chambers, and in particular the prosecution is a highly funded institution, the prosecution has a large number of staff that can investigate these cases and may follow these cases. The defense doesn't have that level of support. I understand that Kosovo is not a rich country, so these resources are limited, but there is a great difference between the level of financing in the past and what has been proposed now. I have concerns whether this will be resolved soon, we will have to apply for legal assistance through the Special Chambers, but I think it will be a stain on the reputation of this government if it continues to act that way”, he told T7.
As for his insistence on the investigation by former Chief Jack Smith due to suspicion that the same was involved in the file scandal, Cadman, who was also a lawyer for Nasim Haradinaj, says the whole situation was suspicious.
The method of handing over the document to the war veterans' association was highly suspicious and never properly investigated, and we think it was either someone within the Special Prosecutor's Office or perhaps a foreign intelligence agency like Serbia, which would have interest. In exposing this process, the essence of the matter is what that report contains. This represents some of the concerns we have raised during the trial and complaint, but we say it supports our argument that Mr. Haradinaj was trapped when he was sentenced”, Cadman said.
