The court found that the mother has hit the baby's head with at least a severe blow, causing a serious head injury. It was deliberate violence, not accident. According to the court, the strike was so strong that the mother should view the baby's death as a possible consequence of her actions.

However, because her mother had sent her child to an emergency after the attack, the court found that she had prevented the baby's death. The baby's injuries were life threatening, and he would have died without urgent surgery. Because of this, the court did not consider the act of mother an attempted murder.

Mother has been sentenced to three years and 10 months in prison for serious assault. Father sentenced to two years and six months in prison for serious assault.
