Caka-Niman mentions some of the women who were killed by men: Their instincts reflect state failure

The Kosovo Constitutional Court, which is based on European human rights judicial practice, must have a primary role in judicial dialogue for implementation of the Istanbul Convention. This judicial practice beyond that is consolidated in the context of principles that are related to gender equality, it has also established principles that connect with the positive obligations of the state for the protection of law in life. The latter highlights a phenomenon that has caused collective anger and concern, the killing of women. In this context, I find that in the beginnings of its establishment, the Constitutional Court has found a failure to meet the positive obligations of the state, respectively, in violation of the law in life with the case of Diana Kastrat”.
“A decade later, the tribunal again finds a violation of the state's positive obligations, respectively, of law violations in the Sebahate Morina case. These two women, citizens of the Republic of Kosovo, victims of mentality and society, and victims of failure to meet the obligations of state institutions unfortunately are not the only”, she said, Klakosova.tv reported.
Caka-Niman further said the initials of women killed in our country reflect the sad stories of Kosovo women who have been subjected to domestic violence.
On August 7, 2018, a woman killed by her husband, along with her daughter, in the presence of family members only because she refused to return to a marriage marked by constant domestic violence. August 6, 2019, a woman killed waiting for a taxi her daughter had called to save her mother from acts of violence by her husband. June 25, 2020, a woman killed in the presence of children by her former husband convicted of domestic violence. January 5, 2022, another woman killed with six bullets in front of girls, convicted of domestic violence. These aren't the only women I'm mentioning just because cases connected with their murders have already ended with court decisions of formal form. The instincts of murdered women are not just statistics, their initials reflect the sad stories of Kosovo women who have been subjected to domestic violence. They reflect the failure of the state, the failure of society, furthermore, their initials call for immediate co-ordination and mobilization in identifying structural reasons resulting in family inequality and violence”, said Mayor Caka-Nimani.
The president of the Constitutional Court also said that “one of the central characteristics of the Istanbul Convention is the call for action and comprehensive and co-ordinated response to all forms of violence against women”, adding that today's conference will be “served as a platform for reflection on the positive obligations of the Republic of Kosovo, within gender equality and prevention and effective combat of gender-based violence<3>.
“The open execution is the possibility of identifying achievements, challenges and solutions. Also, the moment of reflection on the sad stories of Kosovo women who have been subjected to continued domestic violence, including the failure of state authorities to protect their right to life. The Constitution of the Republic of Kosovo includes higher values and standards in the context of fundamental rights and freedoms, including gender equality. Their effective living in practice is possible only through a steadfast commitment to co-operation and dialogue and through continued advancement of mechanisms that enable full implementation of the obligations stemming from the European Convention for Human Rights and the Istanbul Convention”, she said.
